They were confused and definitely overthinking and misinterpreted something.

There has never been such a requirement. So no rule change or anything either.
Thanks, CR001. Clears it up!

Re: Forgot to add applicant name on referee declaration form

I empathize with this, as this almost happened to me. It's easy to miss since they don't highlight the line were you are supposed to fill in the applicant name. It was my referee who pointed it out! From other posts it seems that when a referee is found not to be suitable, they inform the applicant ...

Re: Can a naturalised British citizen be a referee?

Thanks. I remember my friend saying it was a struggle to find referees because they had to be born British. This was 2018, I think. So either she was confused, or that was the rule at the time, and it changed? I really can't find anything on it, so I am just assuming she was just overthinking it, un...

Re: EU Settlement Scheme - Settled Status rejected unfair rules

I moved to the UK in 2017 and held a Tier 2 visa. In 2020 I switched from Tier 2 to EU settlement pre-settled. I applied to settled status this year because I thought that I had 5 years continuous resident in 2022 because I moved in 2017! Yes, this is a very common misinterpretation of the text fro...

Can a naturalised British citizen be a referee?

From the wording of official guidelines, it seems to me that as long as one is a British passport holder, and, of one of the accepted professions or over 25, one can be a referee regardless of the fact one is a naturalised citizen. In other words, there is no requirement to have been born British to...

Re: EUSS Family Permit Timeline - Durable Partners

And, contrary to what many have said on here, I can now say you do not need to show evidence of joint financial responsibility, or the like, with your parner (if you have no children together) to prove the relationship is durable. My partner and I have no children, don't share a bank account, don't...

Re: Can EU dependent live separately?

hi, sorry, I did not get it what do you mean by that "pre-settled status is not an extension of the family permit." It's terminology. Family permits cannot be extended in the same way a Tier visa can be extended (as in extending the validity of the same type of document). Family permits are a one-o...

Re: Naturalisation: when is it ever worth applying via an agent?

To answer your actual question: In general, it is worth contracting the services of an immigration advisor when your case has factors that make it very difficult or impossible to deal with under normal immigration rules. For example, if your case is a rare exception, or something that has never happ...

Re: Naturalisation: when is it ever worth applying via an agent?

Yes, I should have been clearer: I know that applying through an advisor does not affect the outcome of the application. I meant if there are common pitfalls that an advisor might spot (before you submit the application) but that a layperson wouldn't, or if someone with EU settled status is such a ...

Can he able to apply "person with pre-settled status under the EUSS in the UK". As far as I can read from the family visas page , having Pre-settled status is condition enough ONLY for EU sponsors. For non-EU nationals, as the wife in this case, she needs to have settled status to be able to sponso...

All of the above, assuming they are both still living in the UK and have not interrupted their continuous residence period for more than 6 months. Otherwise, things are more complicated, if not impossible.

Re: EU Scheme Pre-Settlement Divorce

OK, I need to correct something: She might be eligible to switch to Settled Status when she completes her 5 years, as domestic violence victims don't need to meet the condition of still being a family member of a EU citizen. However, the central answer holds: she won't be able to sponsor anyone thro...

Re: EU Scheme Pre-Settlement Divorce

She cannot sponsor anyone, as she's not a EU citizen herself. Her Pre-settled status might be valid until expiration day, if she does not exceed the allowed absences; but after that, she won't be able to switch to Settled Status, since she is no longer married to a EU national. Given she's not worki...

Re: Travel in and out the UK while EUSS is pending

However, there's no telling if the OP's status has been rescinded prior to now. Yes, there is. He can simply check it online. If it shows up, then it is still valid. Actually, that's what he should do right now. The rejection letter for his spouse clearly states that OP has no status here. Not at a...

Re: Travel in and out the UK while EUSS is pending

For ILR, he would need to have a sponsor for his visa and then he could bring his wife with him on a dependant visa; which is what he said he had before and is why his wife was allowed to live in the UK while her visa was valid. Those visas have expired. Technically, the wife's visa expired; but th...

Re: Travel in and out the UK while EUSS is pending

If the HO has discovered that OP doesn't even have a pre-settled status (issued in error), As I see it, the OP has status that could still be considered as valid, but it's very fragile by the fact that it was issued in error. From other posts it seems HO seems to take the easiest route in these cas...

I DIDNT UNDERSTAND THE REASON PROPERLY. The answer is right in front of you. Given the evidence provided is dated from 2022 only, and you have provided no further evidence ...
