I also had fine and 4 points. No criminal record. Many people on this forum advice to disclose it anyway. But I am not sure why I should do it. It says spent or even unspent conviction. However, I have Police Certificate which confirms I never had any convictions. If any expert could advice please w...

I suggest you to carefully read my previous messages. You may not have any conviction at all. Disclosure Scotland shows not only criminal record. Order some other Check. And search this forum for my previous posts.

Are you sure you have criminal record? If you don't have then it's not a problem.

You can order police certificate which will show exactly if you have anything or not. http://www.acro.police.uk/police_certificates.aspx

Rental income, minus mortgage payment or not?

Hi If we show income for partner of settled person to apply for visa from rental income. It says it can be income before management fees. Do they mean that we may not deduct mortgage repayment as well? For example, I rent out flat for 1000 pounds. My mortgage is 800 pounds. Can I claim that I have r...

LOL After more research on this great forum, I found answers to my questions myself. Check out my last message here for my findings: http://www.immigrationboards.com/viewtopic.php?t=120689 Thanks to everyone who participated. I hope it will also help to people whom would worry like myself to relax f...

I found some info about Disclosure Scoland already on this forum. Basically, in answers a lot of questions and worries. DS stores all data which happened in Scotland, not only PNC / CRB record. So if it's not on ACRO / PNC but only on Disclosure Scotland, it means you simply had it recorded in Scott...

Thank you very much. Did you attend the court in person or it was decided in your absence? The reason I ask, I got offence in Scotland and it may be just FPN, so I try to figure out if I should declare it in the form or not.

Have you checked if you have a criminal record, and whether this offence (CD 10) is noted in your criminal record and/or as an unspent conviction? In Scotland, motoring FPNs are dealt with by procurator fiscal, an officer of the court, hence all FPNs are dealt with by the court. This doesn't necess...

You can order SAR from local police station, it won't show anything.

I wonder, should we attach it to application form just in case. So that UKBA won't be able to accuse us of having criminal record?

I hope Sushdmehta would find time in busy schedule and, hopefully, reply to this topic.

Pqek, did you mention this fine on ILR application form? Did you tick the box that you have criminal conviction? Did you send your SAR report together with ILR application? Thank you.
I have exactly the same situation, going to apply for ILR soon, would be grateful for your advice. Thanks a lot!

Ssidd, yes, exactly like that. Then I decided to apply for US tourist visa and I ordered ACRO police certificate. Thank you for your reply. Can I ask you, are you solicitor and/or did you have similar case? The reason I asked Sushdmehta is because I think he is solicitor. And I know many people have very good intentions but I would prefer to see opinion of professional based on the law and practice. If you are ...

Yes, I agree with you. You have nothing to worry about. I fall into Scenario 2 a). Mine is not recorded on PNC. And also Sushdmehta said that it looks like FPN in any case. There is also definition of recordable criminal convictions and most driving offence do not fall under this category (you can c...

Question to Sushdmehta, new criminality threshold (traffic)

Thank you for updating Criminality Threshold sticky. If you remember, I wrote that Disclosure Scotland showed my 200 pounds fine and cd10 traffic offence. Now, I had some news. I requested other check from Association of Police Officers ( http://www.acro.police.uk/police_certificates.aspx ) which US...

Yes I know it but why they made it so confusing? Well, I think they deliberately make it so confusing so that in case of some sort of crisis, if they don't want immigrants, or some particular immigrant or group of immigrants, they can interpret these rules as they want. There were a lot of fine exa...

And just to clarify. By new rules they ask for all spent and unspent convictions. I never had conviction, so I don't have to declare my small fine. But because they wrote the form so confusing, I will better declare it just in case. The fact that they ask now for even spent conviction does not make ...

Well, I asked the same question myself. I have small fine and it does not show on PNC. I got letter from Police Officers Association which officially states that I do not have any criminal convictions. But the form is designed in a confusing way (I think deliberately). They ask for spent and unspent...

I myself also did not commit recordable offence but for some idiotic reason it shows on Disclosure Scotland. Check google for definition of reco...

Well, it seems clear to me too. The question is what sort of convictions will delay application by 24 months. I don't think CRB can be used as certain guidance here because sometimes it shows non-recordable offences. I think Border Agency means only recordable offences (which potentially imprisonabl...
