You both need to pass the Life in the UK test for ILR, it's mandatory for all categories, and you're not excluded if you entered before the test was introduced.

You can't just remove your daughter from the UK. You need to consult a solictor who specialises in family law for advice on your rights of somone who has a daughter with his ex-partner. Follow Vinny's link for information regarding your rights to remain for continued access.

Did you submit a tax return to the HMRC? If not, this is maybe why they
were suspicious of undeclared income. Even if you haven't drawn a wage, you would still need to submit an annual return...or maybe you did?

The current fee for spouse settlement visa is £585...apply on form VAF4a before entry. Are you applying for ILR as a spouse following 2 years in the UK? If so, is the 6th October, 28 days before the equivalent date you first entered the UK?
You can start calling the PEO appointment line 6 weeks before the date you qualify to apply.

If you married in any church other than a Church of England without a Certificate of Approval from the Home Office, then the marriage won't be recognised for Immigration purposes, even if the church was licensed for marriages. In addition the marriage doesn't give the legal right to remain in the UK...

Remember it's 28 days before the 2nd anniversary of the 1st date of entry into the UK (not visa issue date) if this a straight ILR spouse application following the initial 2 year visa.
It will be rejected if you submit the application earlier than the qualifying date. Why not apply in person?

If anyone has a gap between the visa issue and arrival date, the concession now in place allows the application to be held on file for processing until the qualifying date...28 days before the 2nd anniversary that you arrived in the UK. This saves you paying a fee of £445 (postal) for Further Leave...
