Re: MN1 form Section 2 question

Given that she was born in the UK the application for her Registration as a British Citizen will be under section 1(3), an "entitlement" application. There is no residence qualification. Simply, you have your ILR, child born in the UK, therefore the application will be granted. No UKBA discretion in...

Re: Born in britain, but can not get a passport! [URGENT]

Wait a minute, your mother moved the the UK as a child. So it is reasonable to think she did not travel alone! That is, someone must have brought her to the UK, but on what basis? To accompany one or both of her parents? If so it is reasonable to ask, what sort of visa did she have? The point is thi...

Re: Born in britain, but can not get a passport! [URGENT]

Do you know your mother's UK visa status? For example, do you still have her US passports? If yes, what UK visas are in such passports?

In any case, it looks highly likely that you are a US Citizen, but again your mother's US passports would be useful to prove that.

Re: british man marridge to none eu citzen with visitor visa

gannanigel, what you were hoping to achieve, getting from visitor visa to spouse visa in the UK, actually got legislated against as long ago as 01.04.2003! Yes over 11 years ago! When the change was made it was known as the "no switching rule". Prior to 01.04.2003 people were coming to the UK as a v...

Re: Child naturalisation of the father ILR

Yes, once you have your ILR, an application for Registration as a British Citizen can be made for your born-in-the-UK child.

The application will be under section 1(3), which is an "entitlement" application ..... no UKBA discretion involved.

Re: Naturalisation application process

I'm now reading information on UKBA saying that residence requirement is minimum 3 years. Not quite right, but what is true that there is an absolute requirement to have been in the UK exactly three years before UKBA receive your Naturalisation application. That 3-year test only applies because you...

Re: Travel to Schengen, without visa, for EEA-family members

You are Dutch. If you are married then your wife will be classed as a Family Member, and thus have the same Treaty Rights as you, and that includes the right to live and work in any other EEA country. Not just Schengen countries! But certainly including those countries. But documentation would be re...

Re: Can I apply for Child benefit for my SON?

Not sure of any link but the principle is very simple. Now that you have ILR you are entitled to claim any benefit that your circumstances dictate that you are entitled to. And any such claim will have no impact upon anything else, including any later application for Citizenship. You have a child an...

Re: Travel to Schengen, without visa, for EEA-family members

So you are British, so your partner is not here in the UK because of EU/EEA legislation.

Accordingly he will need a Schengen visa to enter Spain or any other Schengen area country.

As soon as you got your ILR you became entitled to claim Child Benefit. The fact that you have delayed making the claim has cost you money!

Make the claim as soon as you can.

hallamking, none of that is a problem. With ILR you are entitled to claim whatever benefits your circumstances dictate you are entitled to. As regards "if someone not working in the qualifying period of 12 months will that effect his/her naturalisation application as they would not be paying any nat...
