If you are here in the UK for ten years or more, you then do not need to rely on marriage settlement, you should apply straightaway for ILR.

Thanks! The students advisor has rejected my application in other university on the basis of completing one phd and then get another one. She didn't mention I am a transfer student. As you have completed a postgraduate research course, you are subject to the 8-year cap. You need to calculate how much time you have spent in the UK on student visas, including the period of time you are asking for on the new course. If it exceeds 8-year cap, you cannot apply at all.
