Re: Savings query

I'm writing this on behalf of my brother. Who has been told by his solicitor that 62000 savings would count towards his wife's ILR due to a "technicality". I sort advice from a second solicitor who told me it wouldn't as the requirement is 62500. I'm really worried for my sister in law please can a...

Re: ILR Eligibility with absence

Hi Zimba, I had return to India due to my mum's illness as I was the only child and had to take care of her. Unfortunately, she passed away on 9 Jun 2020, and I could return only on 8 Aug 2020. Will this be considered under Absences for serious or compelling reasons ? Thanks This is up to the UKVI ...

Thanks!
Could you please confirm that three letters for my over 18 dependent child will enough? Or do I need to add 6 letters on his name ?

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

Thank you so much both for your support and guidance, it has been extremely helpful. I am starting her MN1 application now and would like to understand how to respond to the question "the date when your parents became settled in the UK". Should it be yesterday's date i.e. the date I got HO email st...

Re: Spouse Visa Accommodation

Yes it should be fine The applicant should provide evidence as to the basis on which the accommodation is or will be owned or occupied (including rented) by the family unit. This may for example be in the form of a copy of the property deeds, a letter from a bank or building society as to the mortga...

Re: ILR Eligibility with absence

Hi zimba, Firstly thanks for your response, No I don't have more than more than 180 days of stay outside in any following years, from any calendar date in the year and not the calendar year this was explained to me by a solicitor so I have followed it. My only stay for more than 180 days ~(186) is ...

She can use her degree then. For SET(O) her qualifying period is the last 5 years and you do not need to prove anything.
She can immediately apply to naturalise after ILR, when you get your British citizenship.

There is no difference. Either route can be used. I suggest the dependant route via SET(O). What English language evidence she provided before? What test and when was that ? She cannot travel outside the UK until her application is decided otherwise the application will be considered withdrawn and n...

Re: ILR & eGates - can they change visa status? And how to check?

This says that the immigration officer may authorise someone who can obtain a leave to remain to go through eGate in order to obtain leave to remain under said categories but someone who has already obtained a leave to remain(e.g. ILR) does not need to obtain anything per se. What am I missing?

Re: Dependent Partner 5 Year continuous on Tier 4 and Tier 2 combined

Yes. There was no difference between PBS dependant routes (No such thing as Tier 2 dependant or Tier 4 dependant etc) Also, the skilled worker rules also do not care if the routes were even different as long someone was your dependant under any route for 5 years, they can apply for ILR. She can appl...

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

Thank you once again! I just received an email from UKVI that my ILR application has been successful. I am just wondering if you'd know of a way to expedite receiving the BRP or can I now use the application number to make her MN1 application? Or as you advised, I should just wait to receive the BR...

Re: ILR Eligibility with absence

What do you mean by each year ?? The rolling calculation under absence rules requires that you should not have been absent from the UK for more than 180 days in any 365-day period, so nothing specific to a calendar year. Do you have more than 180 days of absence in any 365-day period?

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

Thank you for your response, it is much appreciated. I came across 'applications from overstayers' guidelines from the Home Office and it seems being born in the UK does not qualify for exception, if the current leave to remain has expired. Have you come across any cases recently where the child's ...

Re: Should I renew my passport before applying for ILR?

UKVI does not affix or stamp anything in your passport at all and you do not need any blank pages, just a valid passport at the time of application is enough. The ILR status is granted to an individual and it is not attached to your passport either. UKVI will either issue a BRP card or soon it will ...

Re: 10 years long residence ILR

I was not talking about super priority service but the 5-day normal priority service which is not offered for SET(LR). You will have no chance of getting ILR unless you qualify on the date of decision. An appeal right will not be useful at all as the decision to refuse would be correct. This is not ...

Re: ILR & eGates - can they change visa status? And how to check?

People with a residence permit in the UK who can also use the eGates will always be admitted as residents NOT visitors. Overriding a residence permit or ILR status cannot happen to a resident with a leave to remain in the UK. How will I be granted Leave to Enter if I’m coming to the UK with Indefini...

The experiences of others may not be valuable as each case is unique. What others experience is not going to match yours. It has always been advised that you should expect 4-6 months for this process. eVisa system should open up to all by this summer

Replacement BRP visa can also take weeks. You may update your address with UKVI in case you need someone else to get it: https://visa-address-update.service.gov.uk/
The eVisa is just an account with proof of your status, so you do not need to be in the UK.

ILR status will automatically lapse if you are absent from the UK for more than 24 months. You then have to apply for a returning resident visa and prove you have strong connections to the UK to return. There are no guarantees that your ILR will be reinstated https://www.gov.uk/returning-resident-vi...

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

There are no guarantees for priority service. The child does not need ILR and does not even need to hold a valid visa, so you do not need to do anything at all. UKVI may ask about the child when you can simply explain that you want to apply to register her and there will be no objection

For SET(LR), the UKVI does not offer a 5-day priority service. If you do not qualify as explained above, you should not apply for an ILR application

1. That is ok
2. They will not get confused, they follow the rules and they know the rules

A cover letter is a good idea, just explain everything and write down that you are relying on the 10-year period between 2011 and 2021 to qualify. The rest does not matter
