Failure to report may be an issue. But I'm not sure myself. Is it AC code?

That why I asked about recklessness but no expert confirmed so far.

Is good character for ILR the same as for Naturalisation?

When you look at UKBA website there is nothing about good character in ILR area, only in Naturalization area of the website. I wonder do they apply the same criteria for ILR in terms of good character as for Naturalisation good character? Good character requirements can be found in Appendix D here: ...

I don't think so. Many people got ILR with court fine and it also depends on what they treat as court issued FPN. So I think that the main ground for refusal for traffic offences is recklessness. So if you are fined for shoplifting then it's definitely 24 months wait, if it's traffic offence it shou...

Yes, I think you are very close to the truth. They must explain it much more clearly. They also added to the confusion with the new rules when they say that it affects only when it created criminal record. It looks like it's not always the case. So if it was not recklessness and no record then it sh...

But there are many examples on this forum when people got ILR with traffic offence. So it should depend on nature of the offence. There is a guidance for good character for British citizenship applications. http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/nationalityinstructions/...

I got advice on this forum that it is usually better to declare it and it should not affect. But I'm not sure if it's a good idea to declare it in case you don't have criminal record. Can some guru advice with the logical explanation, is it good idea to declare traffic offence if CRB is clear? It wo...

I also had fine and 4 points. No criminal record. Many people on this forum advice to disclose it anyway. But I am not sure why I should do it. It says spent or even unspent conviction. However, I have Police Certificate which confirms I never had any convictions. If any expert could advice please w...

I suggest you to carefully read my previous messages. You may not have any conviction at all. Disclosure Scotland shows not only criminal record. Order some other Check. And search this forum for my previous posts.

Are you sure you have criminal record? If you don't have then it's not a problem.

You can order police certificate which will show exactly if you have anything or not. http://www.acro.police.uk/police_certificates.aspx

Rental income, minus mortgage payment or not?

Hi If we show income for partner of settled person to apply for visa from rental income. It says it can be income before management fees. Do they mean that we may not deduct mortgage repayment as well? For example, I rent out flat for 1000 pounds. My mortgage is 800 pounds. Can I claim that I have r...

I found some info about Disclosure Scoland already on this forum. Basically, in answers a lot of questions and worries. DS stores all data which happened in Scotland, not only PNC / CRB record. So if it's not on ACRO / PNC but only on Disclosure Scotland, it means you simply had it recorded in Scott...

Thank you very much. Did you attend the court in person or it was decided in your absence? The reason I ask, I got offence in Scotland and it may be just FPN, so I try to figure out if I should declare it in the form or not.

Have you checked if you have a criminal record, and whether this offence (CD 10) is noted in your criminal record and/or as an unspent conviction? In Scotland, motoring FPNs are dealt with by procurator fiscal, an officer of the court, hence all FPNs are dealt with by the court. This doesn't necess...

You can order SAR from local police station, it won't show anything.

I wonder, should we attach it to application form just in case. So that UKBA won't be able to accuse us of having criminal record?

I hope Sushdmehta would find time in busy schedule and, hopefully, reply to this topic.

I have exactly the same situation, going to apply for ILR soon, would be grateful for your advice. Thanks a lot!
