The exempted applicants are HSMP Judicial Review, Domestic Violent victims, Applicant under 18 and over 65. Medical condition, which prevents someone from being able to take it. Every other applicant require it.

You obviously would have received an ILR, four years after the issuing of that Resident Permit, did you not?

You would have been issued with ILR Pre-Directive 2004/38EC rule.

That ILR has condition, that you should not be away from the UK for more than 2 years, have you?

Unfortunately not. He would have to finish the probationary period and pass his life in the UK test, in order to qualify.

The only way time spent outside the UK would have counted, is if you lived outside the UK as married couple or cohabiting partners, for a period of four years.

Provided the father is British Citizen in any other category other than by descent, the child will qualify for citizenship immediately.

If the father was not born in the UK but naturalised as British, the child will still qualify.
