The choice is yours. There are two separate routes and one has financial requirements. You'd better apply when eligible at the earliest

Yes, you may apply and see if the UKVI exercises such discretion. At the end of the day, you do not normally qualify and so it is up to you to apply or not

Your son can be included in the same application using SET(M) form. Absences do NOT matter, whether long or short.

So that I can plan uk stay accordingly ? No. There is no automatic 7-year path to ILR for children. The dependant children of migrant wor...

Thank you for your response. According to my calculations, she will be eligible for ILR on 24/06/2024 after completing 60 months minus 28 days on her current visa. What would you recommend? Should she apply with us and delay the biometrics until her eligibility date, or should she apply separately ...

Re: ILR set(m) questions

1. Yes. The increase will not apply to those who already hold a visa under Appendix FM and who are on the five-year partner route before 11 April 2024. They will only need to meet the current £18,600 per year income threshold when they make a further application. 2. Yes 3. Very likely will face no i...

Hi Zimba , Thanks very much for your reply. But in my ILR application they specifically asked my Wife's Employer -company sponsor licence number. Re: Indefinite Leave to Remain via the Domestic Violence Route

Did you read the guide or not ??
Your time spent under the family route is quite short, so you are very unlikely to secure ILR. What is your immigration history ?? Did you marry him recently ?? You may be able to be granted leave under other routes but getting ILR might not be possible

Re: Query for applying as ILR dependent visa

Switching has no effect on your 10 year lawful residence as advised. Just note that the rules covering the 10 year route are changing. Do you have uninterrupted years of lawful residence up until now without any periods of overstaying ??

Make sure to submit her application BEFORE her visa expiry. This is not a matter of explaining. The rules will render her an overstayer if she applies after her visa expiry. Apply now and explain later.

They do not have to get an exact number. When above 540 days, then they just can refuse the application.

Re: ILR Refused through SET(LR), but married to British Citizen - options?

Some calculations do not look right to me. e.g.: 08-Oct-23 11-Oct-23 3 days 32 17-Jun-23 20-Jun-23 3 days 33 The first line should be 9th and 10th so it is two days The second line should be 18th and 19th, so again two days Can you double-check your calculations? Only exclude the departure and entry...

Re: ILR Application - Minimum Financial Requirement unlikely to be met

You clearly do not read what has been covered above, the annualised calculation applies ONLY to the last 6 months of earnings !!! No. You need to meet both parts 1 and 2 to qualify under cat B. For part 1, the annulised income calculations will be based on max of the last 6 months . You could have b...

Each job will be annualised separately and then the total combined. You also need to satisfy the other requirement that shows you earned in total the min required salary over the last 12 months. I covered this in detail above and you can see this in the guide !!

There are no guarantees and the ILR sometimes can take up to 6 months. UKVI probably is investigating something and will get back to you when they are done
