Re: When does the clock for days absent in the past year stop?

You can travel outside the UK if you’ve applied for British citizenship. You need to consider whether the absence would impact on their future intentions in the UK, see from page 30 of the caseworker guidance - https://assets.publishing.service.gov.uk/media/64e626141ff6f3000d70aeab/Naturalisation_as...

Re: Claiming UC

Ok so two things: 1. Yes you are eligible to claim UC, as you’re settled. However your spouse, if subject to immigration control eg no recourse to public funds restriction, then they would fail the habitual residence test and your claim would be paid as a single person, but would consider any income...

It’s not a public fund and you can apply for free childcare.

Re: Universal Credit

The GP should not refuse a fit note if she’s had back surgery. She needs to be assessed for work capability and he needs to claim carer element if she gets daily living PIP. It must be a joint claim if both eligible.

If they have indefinite leave to remain, the Home Office will consider they meet the legal residency test and also disregard the last 10 years residency issues insofar as there were not further character issues after that period.

Logistically I’d suggest waiting until she returns to the UK, insofar as she has valid leave to return.

Thank you, this was released in October and fundamentally there isn’t much difference but there is a nice useful table, I shall look in depth and see if an update is required.

Re: Home Insulation grant

No, as you’re not renting there shouldn’t be an issue about claiming UC. Your spouse would need to claim but would fail the HRT and therefore would have her side of the claim closed leaving you with a single claim but any income/capital she has would need to be declared each month. Whether you would...

Re: Council tax joint tenancy support

Potentially. If you were not present in the household and your partner would otherwise get a single person discount on council tax liability then your presence increases liability by 25% and therefore increases council tax support which in turn increases the amount of public funds paid.

Re: Question on eligible public funded benefits for ILR holders

Dear Amber, Thank you very much for your kind replies, I will pass these to my friends, much appreciated. To avoid any possible issues in the future, would you suggest they wait until their UK-born child receives their British citizenship certificate, and then apply for child benefit for this child...

Re: Need help with DWP letter

Yes although your claim gets closed as you fail the HRT any income/capital you have still needs to be reported to UC each month. You should write to DWP debt management and ask them to remove your name from the debt letters.

Thank you Amber, much appreciated! They should wait until they have confirmation of status. Qu...

Why has he been overpaid? Has he repaid the overpayment? Insofar as you failed the HRT and it’s a single claim, then you don’t get UC and they shouldn’t be trying to collect from you,

Re: High Income Child Benefit Charge

You can choose to either: - get Child Benefit payments and pay any tax charge at the end of each tax year or - opt out of getting payments and not pay the tax charge What you pay at the end of tax year depends on your income, it’s a sliding scale between £50,000 and £60,000 after £60,000 there would...

Re: Universal Credit and claiming Dental treatment charges

For help with NHS cost eg dental costs, there are two different types of help, 1. Automatic help if you get a qualifying benefit and 2. the low income scheme. For 1. As you have stated UC in your title, for universal credit then a person will be eligible for automatic help if they receive UC and: yo...

And they are still waiting for their ILR BRP cards to arrive, plus they haven't applied to register their UK-born...

Re: High Income Child Benefit Charge

Do you have a partner? If so what is their immigration status?

If you choose to opt out of getting Child Benefit payment, you should still fill in the Child Benefit claim form. You need to state on the form that you do not want to get payments.
