Re: Section 17 funding

Exactly so you need to seek a solicitors advice about a child arrangements order application. If she’s on a spouse visa she may be able to apply for settlement under the domestic violence provisions and soon have access to public funds. We can’t advise any further on this matter.

Re: Section 17 funding

As Casa says it’s difficult to know what your wife has stated and what if any allegations have been made against you. She may not want to have any contact with you and I very much doubt she wants you to have the children, that will be a matter for the family court to decide. In terms of funding unde...

It depends if you have access to public funds, generally the Hong Kong BNO visa does not give access to public funds. If you don’t have access to public funds then you are subject to immigration control and cannot access social housing unless an exception applies. See - https://assets.publishing.ser...

JB007 have you actually read what the OP has stated? They are a joint tenant with their partner not someone else so it’s not an issue.

It might mean your citizenship application has been decided and they’ve closed your ILR status down? You’ll need to contact the Home Office to raise it.

Re: Universal credit and Tenancy agreement

If the UC claimant is a joint tenant with a partner who has NRPF, their assumed 50% share of the rent is used to calculate the ‘core rent’ for the housing costs element. As the person with NRPF is not part of the UC claimant’s ‘benefit unit’ they are arguably treated as a ‘joint tenant’ rather than ...

It shouldn’t, she still needs to claim UC then link the claims, but if she’s subject to immigration control she should fail the habitual residence test and the claim will be single.

Re: Social fund for disabled child

It’s not a “social fund” as that’s specific and related to benefits. What you mean is social services support and social services’ support is not classed as a public fund for immigration purposes and can be accessed by a person who is subject to the ‘no recourse to public funds’ (NRPF) condition. So...

It is potentially possible, you are correct that “children with settlement and residence is potential” see page 29 of the caseworker guidance for further details - https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1173000/Registration_as_British_citizen_...

Re: Spouse visa and Universal Credit

It is correct that the claims are linked but then the PSIC will have their claim closed, they will fail the HRT and will not be eligible for UC. It is not always the case that RTI information is received from HMRC, as I said above it is up to the claimant to report each month their partner’s earning...

Re: Urgent help needed for NRPF T1 ENT PBS Partner/Dependent

Insofar as the person subject to immigration control hasn’t claimed public funds there shouldn’t be an issue, there is nothing here to indicate that any issue should arise. I’ve assumed no council tax reduction/support claimed.

Re: Spouse visa and Universal Credit

CR001 has given the correct advice, the OP states they have created a joint account but their claim was closed as subject to immigration control, that’s correctly what should happen. As CR001 states it’s up to the OP’s partner to inform UC every month of any applicable income or capital the OP has, ...

Re: CB whilst the child's BRP says No Public Funds

I wouldn’t worry about the child benefit claim and would just leave that. The council tax discount, they must be informed and you will owe the 25% for the period in which you were not entitled to a single person discount.

Re: CB whilst the child's BRP says No Public Funds

Assuming your child has no recourse to public funds, you claiming child benefit would not affect your wife’s ILR as she didn’t claim public funds, whether it affects your child, is more of a grey area, as I’ll explain: There is a qualification in the rules which says: “(i) a person (P) is not to be ...

Re: Tenancy Agreement Universal Credit

As a couple, they’d be treated as jointly liable for the rent for UC even if not joint tenants on the tenancy agreement- as long as one of them is named. The issue really only proves problematic when a couple separate as it can create an “untidy tenancy”. I assume neither of your parents are subject...

Re: Mistakenly applied for child benefit while on presettled status

1. In this post the OP is specifically worried that they’ve claimed Child Benefit and breached their immigration conditions. You have started to advise (although it was incoherent) without actually knowing what the client’s status is. If it’s a person with LTR under Appendix EU of the immigration ru...
