Have I missed something here? The ILR fee of £850 is the same for all....whether you're on minimum income as spouse etc or self-sufficient with savings/income of £25,000+....so how have the goal posts been moved? Why would they expect to be issued with an ILR visa free of charge?

Under UK law, you don't have to register your marriage here, so this won't have any affect on your husband's ILR.
Has he past the Life in the UK test or completed an ESOL Citizens course yet?

As far as reporting her to the Home Office with the intention of revoking her ILR...you would 'shoot yourself in the foot' as you would be admitting to a false declaration when signing the application form...which would be considered a criminal offense.

Wait for confirmation regarding how long you can be living apart to lose the right to apply for ILE with KOL. The ruling as I understand it is that the most recent 4 years must have been spent living together outside of the UK. I'm not sure how long the break in this can be.

Is she paying tax and NI on her self-employed earnings?

She will have to apply to the Home Office for a Certificate of Approval to marry. Wait for confirmation from others, but as an EU citizen she may well be exempt from the 'over 21' rule.

I'm afraid that Wanderer and UKBabble are right. It's a frequent misconception that a COA application gives the right to remain...resulting in many illegal overstays when the visa has expired.
All the COA gives is the permission to marry in the UK...nothing more.

I believe the intention is that the new Probationary Citizenship won't be a 'permanent' as ILR is at present and will be revokable under certain circumstances.

I'm not sure that I fully understand you. A COA doesn't give legal status in the UK...it's simply permission to marry. The HO may well consider this is not a genuine relationship if you already had a pending COA (later refused) for a marriage to someone else while this new relationship was already existing. Remember that everything is on record.
