Re: URGENT HELP: Graduate Dependent Visa for baby born in UK

Actually, there are rules that allow a UK born child to apply for an entry clearance or leave to remain in-line with parents. But there seems to be no obvious application paths for them. Make enquires or complaints . Ask your MP for help. Also try emailing FamilyOpsPolicy@homeoffice.gov.uk to clarif...

Note that physical BRPs will be extinct from next year as they are moving to digital status only. Moreover, they cannot even be used for employment nor accommodation purposes now.

Why not naturalise instead?

Re: ILR based on 10 years as a student ..... gap ??

Interpreting “disregard”.

An out-of-time application within a specific time-frame may be disregarded for purposes of making a suitable and eligible application. However, any periods of overstay are excluded from (not counted towards) the qualifying period for ILR.

Re: Can I apply for ILR 10 year long residency now? please help.

If there aren’t any questions about overstaying, then there’s no harm mentioning it. Your calculations seem correct. It’s important that you apply in-time, prior to expiry of leave, perhaps even before the rules changes , on 9 or 10 April. If you satisfy the relevant requirements on the rules in for...

I think that not having a Pakistan visa would be okay with the application. Was the child’s passport stamped on entry?

Re: Certificate of entitlement for child born abroad to british parent

Yes. Child is automatically British, if father was naturalised prior to child’s birth. Moreover, a child born from 1983 has a RoA iff child is British. If born before 1983, some Commonwealth non-British nationals may have a RoA. So, put “British” and don’t leave it blank, simply to highlight child’s...

If child is British, then put British. Else, spouse’s financial requirements under E-ECP.3.1. may increase per non-British child.

Re: Urgent Help with IHS form for settlement visa for Child

If child was born in the UK after a parent has ILR, then child is automatically British. Child may apply for either a British passport or a CoE-RoA. Child cannot apply for a UK visa.

If her circumstances are the same as her last extension, then she may keep on extending, until she can rely on 3.2.

I think she requires at least a B1 level English Language for ILR. Else, She may extend her leave for a further 2.5 years.

Re: Applying for ILR while Plenty of Time on Current Visa

Having more leave than necessary is not a ground to refuse a valid and eligible ILR application.

However, if she did not have leave as a spouse under Appendix FM for the whole of her 5 year period, then she may be ineligible for SET(M).

They should have disregarded the 9 days overstay, if you had made a FLR(M) application and satisfied all the normal requirements under the 5-year route and provided a good reason for the delay of the FLR(M) application. If they placed you on the 10 year route, then your qualifying period for ILR und...
