Re: Switch from Health and Care visa to Skilled Worker visa

Only if and when they choose to extend or switch? If you extend or switch your visa, your partner or child’s current visa will still be valid until its original end date. Your partner or child need to apply to extend or switch their visa, either: at the same time as you at any time before their curr...

The UKVI is appealing and some caseworkers are apparently already jumping the gun and disregarding this judgment.

Re: Most efficient visa option for Thai national looking to work in the UK for 8 months?

Bing ’s answer: I'm sorry to tell you this, but it seems that getting a UK internship visa in the hospitality sector is very difficult. According to the web search results, the main sponsor for the Temporary Worker GAE visa, formerly known as the Tier 5 visa, is BUNAC¹. However, BUNAC does not spon...

Re: Shall I withraw FLRFP child application and apply for British citizenship?

If child is granted British citizenship, then this may benefit the parents’ FLR(FP) applications.
Once a child becomes British, the argument that it would not be reasonable to expect them to leave the UK becomes all the more compelling.

Re: UK Visit Visa for 2 years & Citizenship

Are there no possibilities given the fact neither of us have intentions to living in the UK as of now? No. One of the requirements is literally the intention to reside in the UK Unless they apply as the spouse of a British citizen under Section 6(2) . However, ILR and residence requirements apply.

Re: I am going to get ILR, but want to know about my depandent VISA for my wife and son

If wife is unable to apply for ILR with you, then both wife and son should extend in the UK before their leave expires, at the same time or after you apply for ILR. They should be granted 3 years’ leave. Son should not lead an independent life and often return home to the UK during holidays from stu...

Re: [HELP] HMPO refuting citizenship decision by UKVI as supporting evidence for passport application

Inexplicably , HMPO do not accept Nationality Status documents issued from 2018 as evidence of British citizenship. I've also provided all the documentation that they would require to prove my father's citizenship directly (i.e., my grandfather's naturalisation certificate and marriage certificate,...

Re: IELTS for 65+

I agree
An applicant for settlement
where
Settlement” means indefinite leave to enter or remain
is someone applying for ILE or ILR.

It’s not someone who is applying for an entry clearance or leave to remain under Skilled worker.

For your child’s British passport application, you should also submit your naturalisation certificate, as that confers your child’s automatic British citizenship.

Re: Visitor visa - 10 years (6 months stay per visit)

For reference, there were at least two previous caselaws regarding these issues prior to the removal of right of appeals for family visitors. They gave some interesting analysis at the time. I think they led to the changes in the Guidance. Genuine visitor: relevant and irrelevant considerations Sawm...

Re: British Nationality for children with settled status but currently staying abroad

If child was born outside the UK, then child is expected to be in the UK and registration is subject to Section 3(1).

Else, child (born in the UK) is entitled to register.

Re: Elderly Parent As Dependent

There used to be a concession for Intra-Company transfer workers to bring dependent parents. Unfortunately, there doesn’t appear to be any provisions under the current work routes for parents as dependants. Even settled people and British citizens find it almost impossible to bring elderly parents.

But after sending an email that my child comes under the section 34.1 not 34.2 the issue got cleared.
Can you clarify what are Sections 34.1 and 34.2?
