Re: Dependent Partner 5 Year continuous on Tier 4 and Tier 2 combined

Yes. There was no difference between PBS dependant routes (No such thing as Tier 2 dependant or Tier 4 dependant etc) Also, the skilled worker rules also do not care if the routes were even different as long someone was your dependant under any route for 5 years, they can apply for ILR. She can appl...

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

Thank you once again! I just received an email from UKVI that my ILR application has been successful. I am just wondering if you'd know of a way to expedite receiving the BRP or can I now use the application number to make her MN1 application? Or as you advised, I should just wait to receive the BR...

Apply for MN1 only after you get your ILR.

She will be eligible for ILR within 28 days of completing her 5 years. She will apply separately in August before her visa expiry and can delay her biometrics for up to 45 working days to benefit from the date of decision: How to apply early and benefit from the date of the ILR decision ? You will a...

Re: ILR Eligibility with absence

What do you mean by each year ?? The rolling calculation under absence rules requires that you should not have been absent from the UK for more than 180 days in any 365-day period, so nothing specific to a calendar year. Do you have more than 180 days of absence in any 365-day period?

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

Thank you for your response, it is much appreciated. I came across 'applications from overstayers' guidelines from the Home Office and it seems being born in the UK does not qualify for exception, if the current leave to remain has expired. Have you come across any cases recently where the child's ...

Re: Should I renew my passport before applying for ILR?

UKVI does not affix or stamp anything in your passport at all and you do not need any blank pages, just a valid passport at the time of application is enough. The ILR status is granted to an individual and it is not attached to your passport either. UKVI will either issue a BRP card or soon it will ...

Re: 10 years long residence ILR

I was not talking about super priority service but the 5-day normal priority service which is not offered for SET(LR). You will have no chance of getting ILR unless you qualify on the date of decision. An appeal right will not be useful at all as the decision to refuse would be correct. This is not ...

Re: ILR & eGates - can they change visa status? And how to check?

People with a residence permit in the UK who can also use the eGates will always be admitted as residents NOT visitors. Overriding a residence permit or ILR status cannot happen to a resident with a leave to remain in the UK. How will I be granted Leave to Enter if I’m coming to the UK with Indefini...

Re: BRP renewal (before 31.12.2024)

The experiences of others may not be valuable as each case is unique. What others experience is not going to match yours. It has always been advised that you should expect 4-6 months for this process. eVisa system should open up to all by this summer

Re: Travelling when BRP replacement

Replacement BRP visa can also take weeks. You may update your address with UKVI in case you need someone else to get it: https://visa-address-update.service.gov.uk/
The eVisa is just an account with proof of your status, so you do not need to be in the UK.

Re: ILR absence and citizenship

ILR status will automatically lapse if you are absent from the UK for more than 24 months. You then have to apply for a returning resident visa and prove you have strong connections to the UK to return. There are no guarantees that your ILR will be reinstated https://www.gov.uk/returning-resident-vi...

Re: Awaiting ILR decision (priority) to apply for child's citizenship registration

There are no guarantees for priority service. The child does not need ILR and does not even need to hold a valid visa, so you do not need to do anything at all. UKVI may ask about the child when you can simply explain that you want to apply to register her and there will be no objection

For SET(LR), the UKVI does not offer a 5-day priority service. If you do not qualify as explained above, you should not apply for an ILR application

1. That is ok
2. They will not get confused, they follow the rules and they know the rules

A cover letter is a good idea, just explain everything and write down that you are relying on the 10-year period between 2011 and 2021 to qualify. The rest does not matter

Do not waste any money on solicitors. Apply for FLR(FP) and vary the application to SET(LR). You will get a refund for FLR(FP) application.

Thank you, I did.
The application doesn't ask any documents proofing his address, life in UK and English test.
I'm going to add his bachelor degree, 3 letters on our address and ref for Life in UK.
Do you I need to proof his financial dependency?
People above 18 can be financially independent

Hi, My SOC code 2137 is from SOC 2010, but there has been an update in SOC, which is the new SOC 2020. Under the old SOC 2010, I was given the ongoing rate of £26,800. However, in the new SOC 2020 my job code has been changed to 2141, where the minimum ongoing salary requirement is £35,800. Therefo...

Re: Dependent family application date

Applying early is possible if you are short of up to 45 working days for ILR, not more than that. That is the maximum number of days you get to enrol your biometrics before your application is rejected as invalid. In this case, the family members will need to apply for an extension before visa expir...
