Re: ILR for spouse

Yes, you should input the previous incorrect SET(M) application number. Any refund will be given probably after the new SET(O) application is decided

Re: ILR for Tier 1 dependents

The fact that you got ILR is not that important for their extension. They can extend their current visa in the UK as Tier 1 dependants and that will be for 3 years. The links are on this page: https://www.gov.uk/tier-1-entrepreneur/family-members If their visa expires while outside the UK and they d...

Re: ILR under Global Talent route - Partner applying separately

Thanks Zimba. Just to remove uncertainty, is your answer "No" for "Don't we need to add evidence of financial support from the sponsor? Evidence of accommodation? etc ..." or for "Does it mean that those documents are enough?" No such documents are needed. UKVI will ask for any extra documents if n...

What you quoted clearly says 12 months under the same immigration route. An extension does NOT change your immigration route

No. For ANY period of absence before 11 April 2024, the last bullet points will not apply.

Re: Need help with Set(M) questions please

You seem to be overthinking way too much 1. That question is not about getting a raise. It is about being above the threshold continuously over the last 6 months 2. The answers on the form do not change her eligibility criteria. As long as she gets paid above the threshold her annual income becomes ...

The increase will not apply to those who already hold a visa under Appendix FM and who were on the five-year partner route before 11 April 2024. They will only need to meet the current £18,600 per year income threshold when they make a further application. https://assets.publishing.service.gov.uk/me...

Your eligibility is based on his previous status as a skilled worker migrant who settled. His current status is irrelevant. Answers on this form do not change your eligibility at all, so answer accordingly

Re: 10 year ILR long residence - 28 days in advance eligibility

There has never been such a thing as '28 day rule'. That is simply a UKVI concession which applies to all applications for ILR

Re: Indefinite Leave to Remain Application with Dependent Child

Children do NOT have a minimum residence requirement for ILR, they settle when both parents settle. If you brought your child here then that means the UKVI agreed with the sole responsibility, so simply add the child to your SET(M) application and you should be all good.

Re: ILR Set(M) declined due to wrong form

I sympathise wholeheartedly with the OP... My wife just submitted her ILR application, but we think used the wrong form... On searching "Apply for ILR Visa" the first/top result was for 'Private Life' - didn't see any mention of 'When (not) to use this form...'! We think she should have used 'Partn...

Re: 10 year ILR route with more than 180 days gap

Hi Zimba, Sorry to ask you again as I am confused, whether I should be considering bullet point 1 or bullet point 2. Should I consider the condition for before 11 April 2024 or after 11 April 2024 where my absence were spread between 2 years for my 10 year ILR which will be completing in Nov 2024 t...

Re: Can ILR Continuous Period Residency Period Start In Absence

The date of decision cannot be determined in advance, so it is perfectly reasonable to rely on the date of application. If someone applies for an in-time application, the caseworkers can use the date of the decision to calculate the 5 years, if this is beneficial to the application

Re: ILR Skilled Worker or Global Talent Dependent - Question

I do not imply such a thing at all as there is no automatic transition or anything like that. I am telling you that a dependant does NOT need to have been granted leave under GTV rules to qualify under GTV rules. The only requirement is that the spouse must have been granted ILR under GTV rules. GTV...

Re: 10 year ILR route with more than 180 days gap

Thanks Zimba. So in my case, my 10 year period will be completed at the end of this year, that means the applicant must not have been outside the UK for more than 180 days in a 12 month period. I was outside the UK for 159 days in 2019 and 33 days in 2020, this was continuous in this 2 years. So ma...

You do not need to quote the rules to the UKVI, they are the ones writing and enforcing the rules.

Re: 10 year ILR route with more than 180 days gap

These transitional arrangements preserve the position that continuous residence will be broken if an applicant has been absent from the UK for more than 184 days at any one time or for more than a total of 548 days overall, where that absence started before 11 April 2024 . This means that: •any sin...

Re: Inquiry on ILR Application Strategies for NHS Worker and Family

You can apply for ILR and this will not affect your dependants at all. They are not required to switch to the family route at all and can remain/extend under the skilled worker dependent route as normal, even after your ILR. Note that your son will follow the immigration path of your spouse and will...
