Your eligibility is based on his previous status as a skilled worker migrant who settled. His current status is irrelevant. Answers on this form do not change your eligibility at all, so answer accordingly

There has never been such a thing as '28 day rule'. That is simply a UKVI concession which applies to all applications for ILR

Children do NOT have a minimum residence requirement for ILR, they settle when both parents settle. If you brought your child here then that means the UKVI agreed with the sole responsibility, so simply add the child to your SET(M) application and you should be all good.

The date of decision cannot be determined in advance, so it is perfectly reasonable to rely on the date of application. If someone applies for an in-time application, the caseworkers can use the date of the decision to calculate the 5 years, if this is beneficial to the application
