Re: Child born in Egypt to British father

Just a little confused on point 3 as JAJ you mentioned that my father wouldn't have been a BC otherwise then by descent until 1983 which would be after my birth. Or am I reading it wrong and his registration in 1975 is sufficient for thsee qualifying points on the MN1application route under 3.2? Si...

Re: MN1 form or S2 or S3 form

Not having a passport doesn't mean that child is stateless. Child has the same nationality as yours & you should use form MN1. Child does not necessarily have the same nationality. Depends on the law of the country concerned. Many U.K. born children are stateless. However- MN1 is still the correct ...

Re: Residence requirements for Irish Citizens applying for BC

The special status of Irish citizens in the U.K. is hinted at in various publications but not written down in a single place. Example references: https://www.gov.uk/guidance/status-of-eu-nationals-in-the-uk-what-you-need-to-know https://www.gov.uk/government/uploads/system/uploads/attachment_data/fi...

The MN1 application process seems like something i could do my self but will most likely get a lawyer to handle the process on my behalf from within the UK...hopefully this can be done considering i will be in Egypt once ...

Re: Help with refused registration of a child

You're going to have to apply to the Home Office either way (sooner or later)- either MN1 or a Nationality Status Certificate application- if you want your child to be British. You say you've retained the services of a lawyer (did you pay?)- has this lawyer reviewed your circumstances against the Im...

Re: British Passport refused for an adopted child of EEA citizen

The Passport Office will accept the Nationality Status Certificate as evidence of British citizenship. They will not need details of child's birth parents, etc. So apply for a British passport in the standard way once this is issued.

Re: British Passport refused for an adopted child of EEA citizen

If you are having hypothetical discussions with the Home Office you probably won't get very far. You need to make the application which the Home Office will then have to consider and either accept or reject. In order to get a Nationality Status Certificate they do not need absolute proof that the ch...

Re: My CENOMAR says my mother was married, will I be rejected?

She was married before and never told you that? In any case- if she was married already then her marriage may well be void -at least under British law- and your British passport application may be rejected as a result- due to lack of British citizenship. However, you may wish to consider applying fo...

Re: The hostile environment: what is it and who does it affect?

It would be interesting to know how many British citizens are effectively forced to have passports as de-facto ID documents and also how many British citizens have been denied U.K.-based services due to lack of a (British) passport.

Re: Child born in Egypt to British father

The Home Office will probably need evidence that the British grandfather of the child- registered in the U.K. in 1975- became a British citizen otherwise than by descent in 1983. A passport in itself does not prove that- so they probably will want to see some details of the registration. In theory t...

Were your details added to your mother's British passport? There is/was a section on the passport for details of children. However- if you'd been added to the passport, then there's no reason for you to have been granted Indefinite Leave to Remain on entry since this is only granted to non-British p...

Registration under section 1(3) of the Act is an entitlement and cannot be refused if the requirements under the Act are met. In other words- apply with whatever references you have should be fine. The Home Office cannot legally insist on particular reference requirements since these are not contain...

Re: British citizenship

What exactly is meant by "came to the United Kingdom in mother's passport". Were you added to your mother's passport? That shouldn't have happened. Non-British children were never supposed to be added to a parent's passport. If you have evidence that you were included in a parent's passport then the...

The fee for form NS is GBP234. Consider it a fee for proving British citizenship. Passports also have fees attached. The Nationality Status Certificate has the advantage of giving a lifetime proof of British citizenship. Passports have expiry dates and and are not as suitable, also can more easily b...

I think the advice is the same as what has been discussed already- whatever evidence you have of the child's birth place and British citizenship/settled status of the natural parents, you need to get a Certificate of British Nationality Status letter for the child. Use form NS: https://www.gov.uk/go...
