The other point to consider....your partner has claimed Asylum. i.e unsafe to return to his own country. If he now returns in order to apply for a spouse visa...it would appear to the authorities that his Asylum claim was false. What nationality does he have? Are you both over 21?

You may be OK as the UK allow dual nationality...it's India that doesn't. If you were applying as a spouse of a British Citizen, you would have to submit their passport with your application...which I guess in the circumstances wouldn't be possible.

No, you need to complete form FLR(M). It's slightly cheaper, but you would need to give a reason for not applying for ILR. Submit at least double the required amount of documents in single names.
What about Council Tax, is that in single name?
The separate bank accounts shouldn't matter.
