Section 3(1) of British nationality act

Hi,

Asking for a friend.

My friend's family got their Ilr this week. All three (my friend , his wife and their son) of them are Indian citizens with ilr now.

Can his son apply for Ilr under section 3(1) now or does he have to wait for one year?

I will be really grateful if someone can answer please.

Unless at least one of the parents is applying/has applied for British citizenship, child must wait for 12 months before applying for registration as a British citizen.
