Separate FLR application for dependants of HSMP holder

Separate FLR application for dependants of HSMP holder

I wonder if there is a separate application form for FLR for dependants of a highly skilled migrant? When I applied for my FLR(IED) I did not enclose my wife's and daughter's passports because they are due to expire soon and I was afraid of sending them to the HO - a delay would have put them in a difficult position ie. with expired passports and visas and unable to travel. We were/are planning for them to go back to our country of citizenship, get new passports, obtain visas and come back to UK. Now that I got my FLR in a week I wonder whether I should send their passports as well?

I would especially appreciate moderators' opinions,

Dear Moderators,

I would greatly appreciate if you could share your opinions on this issue - my wife's and daughter's visas expire on 1 June and the passports on 13 June. Should I try to renew visas here or do as I originally planned?

Can you not get this done at an embassy/consulate in the UK. They should be able to issue you new passports in a matter of days. All countries have consular services at their embassies.

There is no seperate application form for dependents. You will have to use the same FLR application form you used for yourself. If you dependents had been included in your application, there would have been no additional fee, however when you apply for your dependents seperatly it will be treated as a fresh application.

hsmphopeful,

1. In country application - use form FLR (O)...unlikley success route given amendments in rules for in country switching.

2. Out of country - they should use form VAF 1.

In both cases any child under 18 can be included in your spouses form. Likewise in both cases there must be evidence of relationship either marriage and/or birth certificates, evidence of accomodation and funding. Given that you don`t state their current status in the UK, I have no idea of success pursuant to any existing/subsisting relationship or ability to switch in country...this may not even be possible.

Thank you very much for response.

There is no switching involved as they are currently on the same HSMP dependant visas. As I say I could have included them in my FLR(IED) application but I didn't. We are exempt from FLR(IED) fee so money is not an issue. So, considering that this would be an application for FLR in the same category they have now, which form I should use?

I will greatly appreciate your insight into this - so should I use FLR(O) to apply for FLR for my dependants? Will I need to send my passport with FLR as well or not?

Or should I use FLR(IED)?

FLR IED not valid for dependent applications. You would use FLR (O).

Rules allow extension where dependents continue such status as same for principal applicant i.e. HSMP dependency ongoing. Given your fee exempt status a day trip to Croydon for an in person application would be of no harm..not sure if this (exempt) would exclude it from being straightforward though..if it is don't leave the application.....get EC back home instead...that is unless you want to wait out for FLR approval. This doesn't resolve the passport validty though.

You would have to get the FLR transferred in country upon your return to the UK if such (re-entry) was on new passports or if you did not travel but got new passports. Again since cost not an issue either option not a problem though always ideal to have your residence permit/ EC on a long term valid passport.

Seems like the best option is the original one - to apply for EC after getting the new passports - will do that way...
