My ex partner and I are officially separated since last month and we notified INIS (EU Treaty Rights) about it. But before that we got a letter from the EU Treaty Rights Division stating that our relationship may be for convenience plus they believed that my ex partner was not in the country exercising his EU Treaty Rights paying taxes etc. We then got a solicitor who is helping us with the case. Apart from that, my solicitor told me that I can’t apply for the retention of my stamp 4 visa as I’m not divorced yet (which is true) but at the same time she told me that while we are waiting the process proving that my relationship was real and my ex partner has always been in the country exercising his EU Treaty Rights, she (my solicitor) told me apply for another visa (stamp 4) as I’m married to an EU citizen even though we are separated. Have anyone gone through this before? Any advice on that? Thanks a lot!
