Set(O) form Quries

In Section 2: It say give details if the dependants are living with you and applying with you,

But my Dependants are not in UK and not applying with me, but how can I let them know about my dependants

I am adding marriage certificate and birth certificate with the documents

Please let me know where to put the details in application.

why do u need to let them know. If they are not applying with you then nothing to mention in SET(O).

why do u need to let them know. If they are not applying with you then nothing to mention in SET(O).
Planning to apply the visa for them next year if I don't declare them now then It will come under deception.

Please let me know

I renewed by passport recently, The tier 1 stamp is on old passport, which passport number to put on the section 1
Always use the current passport number, old passport would have been cancelled.

Should be left blank. Apply for them when they intend to come to live with you.

I had a baby in Jan 2011 now if I apply for ILR in June 2011 without submitting the birth certificate for kid will it not come under deception when i apply for the visa for the kid in Dec 2011.

I have seen few cases of tier 1 dependants where they got rejected for not letting them know they are married at the tier 1 application.

1- Your child's birth certificate and your marraige certificate should be dated before you get ILR.

2-Their passports will show they were not in UK when you got ILR and hence couldnt not apply with you.. That proves there is no deception Also if they are currently on dependent visa that's an additional evidence.

There is no way to "notify UKBA re dependants which are not applying with you.". They dont accept advance notices saying "by the way note that i have two dependants who will be applying in future".

Stop stressing yourself.

I am not too convinced by that sentence alone. If they tried to hide something to get a positive outcome of applicaiton that a application can be refused but in your case you are not trying to do that.

For clarification: You are in UK, your baby and other dependants are outside UK. Your dependants have never been to UK. You are now applying for ILR and using Set O forms

If above is correct: You need to fill the form with no dependant information as they are not living with you in UK and are not applying with you.
Use Section 7, to give this information and say that they will be applying for leave to enter later in the year. They will have to apply from outside the UK, you will then need the marriage and birth certificate

Section 7 is for criminal convictions etc. There is no place to enter dependant information.

Firstly I would like to thank xyz123 for your comments

I am going in person next week but before this I been to few solicitors and i don't why they all said me to submit marriage certificate and birth certificate even though if they are not applying with me.

May wife been here on tier-1 dependant visa but due to medical reasons she cant be here for ILR application with me so her visa will be expired soon.

Planning to apply for them in Dec 2011,

If you are still worried, take those documents with you and show to caseworker. tell them ur worry and see if they want to see those documents. caseworker are usually very helpful. good luck.

The heading of the section explains that it is for dependents who are also applying. Your dependents are not applying, hence you leave that section blank.

Entry clearance forms ask for more details about parents, spouse, ex-spouse and children than ones that are used in the UK. This may be where the confusion has arisen.

What section 2 heading says is give details of the dependents who are applying WITH you. not give details of your dependents if there are any!

so if you do not plan to include any dependents on your ILR Set O form then leave this section blank.

Thanks to all those who commented on this topic, Now thats for sure i dont need to put the details in section 2, But still i dont know why the solicitors asked about the certificates i will see them soon and find out the reason.
