SET(O) ILR application questions - SOC, COVID Concession

Route: Main applicant – Tier 2 (General) → Skilled Worker (SET(O))

Timeline:
First UK entry: 10 Aug 2019 (as PBS dependant)
Switched in-country to Tier 2 General:
Application Submitted: 28 Aug 2020
COS Work starts date : 7 Sep 2020
Visa granted: 28 Sept 2020
Most recent grant: Skilled Worker valid to 04 Oct 2026


1. Based on the timeline above , is my earliest valid ILR submission date, considering the COVID concession, would be 10th August (28 days before COS start day) or 1st July (28 days before application submitted)


2. SOC code change
My last CoS shows SOC 2136 (Programmer/Developer). Since then, the SOC list/descriptions have changed to IT Quality Analyst.
For ILR application, should I quote the SOC from my most recent CoS (2136) or the updated SOC code that now applies to the role?

3. Home Office reference numbers in application
I can provide the references for my Tier 2 and Skilled Worker applications. I first entered as a dependant but I can't find that older reference.
Is it necessary to provide the earlier dependant reference?

4. I work 40 hours a week, but my last COS shows 35 hours per week, which one should I mention in the application?

5..I'm doing it by myself, so re-confirming, I need to apply via Set(o) application, right?

1. It has nothing to do with SOC issue date at all.
(28 Aug 2020 + 5 years - 28 days) is the earliest ILR eligibility date

2. The Standard Occupational Classification (SOC) codes assigned to each role have been simply updated from the 2010 codes to the 2020 codes, so your old SOC and the new 2020 SOC should effectively refer to the same role/title. You should use the equivalent 2020 SOC to determine your salary requirement for ILR. Enter your job title on the CASCOT occupation coding tool to find out the correct SOC 2020.

3. Leave it empty. You do not need to enter that

4. Your salary must be pro-rated to match the SOC working hours.

The SOC codes for each role have just been updated from the 2010 version to the 2020 version. Basically, your old SOC and the new 2020 SOC refer to the same job. To figure out your salary requirement for ILR, just use the equivalent 2020 SOC. You can enter your job title in the CASCOT occupation coding tool to find the right code.

Congratulations, may I ask which date have you used to count your ILR qualifying period? The Tier 2 visa application date or the COS work start date?

Also have you applied using priority/super priority?
