Set (LR) or Set (O)? From Limited Leave to Remain to BNO visa

Post by Edigla2857 » Wed Dec 20, 2023 7:28 pm

Hello to all and I hope you're keeping well,

A friend had recommended me this board after having helped him complete their ILR successfully. Apologies in advice if this has been asked before: I have searched but been unable to locate this.

I am currently looking to apply for ILR, after having had continued residency in the UK from Feb 2013. Previously, I had been on the LR route via Limited Leave to Remain, but was advised to migrate to the BNO Visa upon its release in 2021 by my solicitor via legal aid. However, I am confused as to which form would be most appropriate, due to the following:

- Set (LR) has requested a current BRP as evidence - no BRP made available after being accepted on the BNO Visa by the Home Office, but I do have a BRP from my most recent Limited Leave to Remain.
- Set (LR) has requested a passport issued by Hong Kong - I only have a passport issued by HMPO; would this be sufficient?
- Set (O) has no indication of evidencing my previous Limited Leave to Remain stays. How would I be able to evidence my continuous stay in the UK?

Thank you in advance for all of your help!

SET(LR) is used if you have had 10 years of lawful continuous residence in the UK on any visa (except temporary visas).
SET(O) is used if you have 5 years of lawful continuous and are currently under BNO visa.

Not everyone has BRP or their national passports as this depends on their circumstances. So you provide the documents that you have
