Settlement application for an overstayer... (Please Help!!)

Post by Monyk » Tue Aug 30, 2005 9:45 pm

Hi! My name is Monica and I am Mexican. I am married to a British person. We have been married for 5 months now and I came to the United Kingdom about 10 months ago. I came here for my gap year and I chose Britain because I wanted to see my boyfriend (who is now my husband), he proposed to me and we got married here. We couldn't go on our honeymoon as we were told that for me to come back to the United Kingdom and stay I would need an Entry Clearance or Visa. So now I am going to go back to Mexico and apply there at the British Embassy.

First of all I would like some advice overall as we are a very young couple. He is 24 and I am 20. He is a personal trainer and he has been working for virgin ltd. for a year now in which he has been promoted twice. we haven't got much savings as he has soome debts (from when he was younger) which he's consolidating nowdays.

We live with his parents in a three bedroom house which they don't own as belongs to the school for who his parents work for. I have been reading all the posts in this forum and I have been trying to get as much information related to our cause as it has been possible.

I have his payslips for the past six months in which is proved that he hasa estable job (until about a month ago he was also working for the council), i have a letter from his employer stating how much he earns and how many hours a week he works, a letter from his parents stating that they are willing provide acommodation for us until we can afford a house (which we hope is pretty soon as we have been seeing a financial advisor for a couple of months with the intention of consolidating any debts and getting a mortgage).

I also have photographs from the beginning of our relationship and from the wedding (photos of him and my parents on a weekend we spent together in Liverpool and of course all the photos from all the holidays and weddings of our relatives we have assisted to). I have our wedding album, wedding guest book, ione sample of our wedding invitation and cards that we received from our families in america, canada , mexico and japan, (which I think are a good proof that our marriage is genuine).

I have bank statements, and also a letter from a employer offering me a job.

The only thing that makes me very nervous is the fact that i overstayed even though that wasnt my intention. And while i was here I had to renew my passport and now that passport says that it was issued in London so if they asked I'd had to say that I arrived here on Octuber of 2004 and till August I remained here. I don't want them to refuse me a Visa because I overstayed and to be honest even if i say that I wasn't aware of the law they are not going to think the best of me.

Another thing is the savings, We haven't got much money in our savings accounts overall because we paid for our wedding which was qiute expensive. So, what should we do?

I am sorry that this message has been so long but if I am going to apply I want to be ready. And I think this is the best place to ask for info.

Thank you for your time.

Monica
