Settlement(ILR): Using SET(O) form - dependents

Hi All,

I am planning to apply for ILR on Tier1 (General) 5yrs.
I have 2 dependents: Wife and Son
I have 3 questions:
1. Wife lived in UK as my dependent more than 2years (not continuosuly). She lived for 11 months and went back home to give birth to my son. When I extended my visa, I have renewed my visa in India. But there was 3 months gap for my visa expration and new visa. Will she be eligible for ILR as my dependent?
2. My visa renewal application was sent back to me after 1 week of expiry due to funds not paid out of my bank due to limit on account. Eventually, I have resend it with postal order on the next day and I got visa after 2months. So I have 10 days gap. Is this a problem?
3. Defaulted credit card - dealing for repayment now. any isse?

Please help me it is urgent!

Did your dep spouse have continuous leave or was there a break?

Default shouldn't be an issue providing you're dealing with it i.e. even £1 pcm payments.

Hi Amber,

Thank you very much for quick response.

Yes, there was a break about 3 months from expiry. She had to renew hers in India when mine extended, with my documents.

Thank you for the reply.

Wife: She got on 01 May 2012.
Son: born in India and got visa on 01 May 2012 and arrived UK with my wife on 8 Jun 2012. Is he eligible for visa?


Me: My first visa 09-Jan-2009 to 9-Jan-2012
Second 23-Mar-2012 to 23-Mar-2014 Is this gap any problem?

When you leave expired outside the UK, did you apply for EC within 28 days?

Child applies with you as per rule 319J. Wife applies in June 2014, extending if necessary as a PBS dep until she qualifies.

Thank you for your reply.

I was in the UK when I have applied for my own visa renewal.

During my renewal period my wife was in India and she applied in April 2012 when I got my visa in March 2012. But it was more than 28 days later (9th Jan 2012 was expiry date).

Thank you for your reply.
Yes, I did apply within 28 days of after expiration.

Details:
My visa was due to to expire on 9th JAN 2012.
I applied on 28th DEC 2011 (by Post).
I have recieved my returned application from Home Office on 21st JAN 2012, due to fees not paid out of my bank due to limit on A/c. I resent the application form on 23rd JAN 2012 with Postal Orders.
I received my visa from 23rd Mar 2012.

Please help me.

Hi Amber,

Thank you very much for the information.

I will apply for me and child by in person application.
Do my wife wait until I recieve my visa and apply by sepearate application? Which form and category I should look for?

PBS dep extension should be made anytime before her current leave expires. By post should be fine, varying to SET(O) if a decision is not made by the time she becomes eligible for settlement.

Would you please confirm if I am eligible my self for ILR? as I mentioned in my first post, My was due on 9 JAN 2012. I posted on 28th DEC 2011. Due to daily limit on my bank card fee was not deducted and application was returned to me on 21 JAN 2012. On 23rd JAN 2012 I have posted the form again with Postal Orders. I have recieved my visa in March date from 23rd March 2012 valid to 23rd March 2014.
Would you think there is gap in my visa? Do I need to see any Solicitors to talk about this?

Please help me.

Was there any change happened to (319J) immigration rules in JAN 2014?
I have booked an appointment for 14th FEB for me and my son.
Is my son still eligible for ILR if applying with me?
