settlement right?

Post by raoul1987 » Sun Oct 23, 2011 7:18 pm

i am currently on tier 2 visa since February 2011. i have been approached by one of the competitors of the company i work for to set up a new branch. anyway before i decide to go for the interview i was wondering will i lose my settlement right if i change employer i.e if i apply for a new tier 2 application in January?. i was reading something about that on ukba that any visa issued after April 2011 wont be guaranteed a direct route to settlement after 5 years.

your opinion will help me decide. i hope i am wrong as i would get an extra 10grand if i go for the new job...
thanks

change of employment does not constitute as abreak in qualifying residence period.

Normally, you can apply for settlement visa after 5 years on tier 2 but the govt is thinking about modifying the rules regarding that. These rules might not be there when you come to apply for settlement visa in , say, 1 year etc.

Do whatever takes your fancy as it would not change a thing for you as far as settlement visa is concerned. you just need to hope that that right is still there after you have lived here on tier 2 for 5 years!

so if i change employer in january, hence file a new tier 2 application, my settlement rights after 5 years wont be affected? i am sure i read some where that all tier 2 visas issued after april 2011 will be treated as a temporary visa i.e no settlement rights after 5 years?
