Settlement or Tier 4 for my family?

Post by jjstocks » Thu Feb 19, 2015 4:00 pm

Hello, I'm a dual nationality Brazilian/British citizen living in Brazil and I've recently been granted a scholarship by the brazilian government for a full time PHD (25200 per year grant). I have a brazilian wife and 2 children.

I would like to know which visa is the more recomended one (considering visa costs and possible benefits entitlement after arriving in UK). As I see it I have two options:

1. Tier 4 Visas (me as a Brazilian) - 301 x 4 (me, wife and kids) = 1204 pounds. Will this allow me to apply for housing benefits if I need it?
2. Settlement - spouse and children (me as a British citizen) - 885 x 3 (wife and kids) = 2655 pounds.

Any ideas?

Thanks

You are a British so you cannot qualify for Tier 4, neither can your wife and children.

Are the children not eligible for Citizenship?

Well if the fact I'm ALSO British disqualifies me from Tier 4 visas, problem solved. The thing is the brazilian government forces me to return to Brazil after the PhD is over so it doesn't make sense that I should apply for indefinite leave to remain visas (very expensive).

My children are eligible for citizenship because I'm British by descent and all I would have to do is live 3 consecutive years in the UK.

Is there any document/law that says I can't apply for Tier 4 visas as a dual nationality citizen?

Section 1(1) of the act, provides that there shall be no hinderance to a British Citizens right of entry and exit from the UK.

It follows that the Entry Clearance office will be imposing this hindrance, which the law prevents them from imposing on you.
