Skilled worker dependent visa extension when main applicant is on ILR

Post by navmani » Tue Dec 26, 2023 9:24 pm

Hello

I got my ILR approved on 21/12/24 via skilled worker route and applying to extend my spouse's skilled worker dependent visa which is expiring 04/02/2024. I understood thatan extension for a maximum of 3 years for skilled worker dependent when main applicant has moved to ILR (via SWR), but my spouse need approx 3 years and 6 months to qualify for their ILR.

My doubts are:
1. SW dependent visa start date was 25/06/2022, in order to reach the 5 year qualifying period (June 2022) can a visa extension application with end date of 24/06/2027 (i.e., 3 years and 6 months approx) be made?
2. If 3 years is the maximum permission for SW dependents as per SW.36.1.(b), the permission to stay will be extended only till Jan 2027 (if applied and approved in Jan 2024). Should we then apply for 6 months extension from Jan 2027 to Jun 2027?
3. Or should I consider to apply for FLR which will reset dependents 5 year qualifying period and save another 3 years which will be spend under SW dependents only then to move to FLR in Jan 2027 as per SW.36.(b) ?

My concern is that if skilled worker have moved to ILR can the dependents extend the visa for more than 3 years (in a single or multiple application) under the same skilled worker dependent to qualify for 5 years without reseting their clock.

Many thanks for the all those helping to answer various queries that are posted in this forum, it is very my helpful.

You can only extend the SVW dependent visa for 3 years (in this case and with current implementation of immigration rules). So it'll be 3 year and 3 year extension (with fees and IHS accordingly). There's no variables.

(b) 3 years’ permission if the Skilled Worker was (or is being) granted settlement as a Skilled Worker.
