Solicitor lied and set me on a wrong path

Post by itiz » Wed Nov 20, 2013 8:15 pm

HI guys,
I consulted a solicitor that advised me to apply a certain route and demanded their legal fees which I paid.

the Home Office threw out the application saying it was outside the grounds of what I applied for. When I went back to the firm, the insisted the HO was wrong and asked me if I was in a relationship with any EU or UK citizen or if I wanted to do a judicial review.

The previous solicitor had left and the new solicitor said she was surprised they told me to follow that route but did not say of any other route to follow

When I denied the above 2 ( marriage and didnt have money ) for a judicial review, they never picked my calls again

Kindly advise

tnx

We cannot give any help without knowing what you applied for and why HO threw it out.

There are systems in place to hold incompetent lawyers to account.

well, my x wife got my tier 2 work permit terminated, hence i consulted a solicitor down in london who advised to pursue flr based on family route, since my daughter was 1 year 4 months then.

After my application was sent in, the HO held it for a long period, eventually throwing it out after i complained about the delay to the MP.

Basis of refusal where

1. My child is not settled and not lived here for 7 years
2. Private life didnt not constitute up to 20 years continuously
3. They said I applied outside the grounds/rules of flr(o)

I was refused a right of appeal, as I was not within the right application boundaries.

I went back to the solicitor and she said she was surprised the last solicitor sent such an application as it was obviously wrong. After that, she never picked or returned my call to date

Kindly advise

thanks

Had you leave been curtailed when you made this application?

How old is the child? Do you usuallly see him/her?

Has the mother applied for ILR yet?

my daughter is 4. Yes I see her. But the situation is very volatile and I am sure it would fall apart any time soon.

I dont know anything about her mum and no she does not have ILR

How can a wife or x wife get tier 2 terminated ? Is there an immigration rule that says that tier 2 can be terminated at the will of a woman?

Why did you do this? You seem to be registered in 2 names. This is not acceptable.

I will have to deactivate one account. Please inform me which of them you intend to deactivate.

Sorry meant to say tier 1 workpermit.

and yes she terminated mine, and it happened as.

we both applied for a tier 1 workpermit, and i was her dependant. The HO held our application for 1 year 8 months. All efforts to get it back via local mp failed twice. So in the heat of the frustration i got a job offer for £30,0000 as a Microsoft programmer.

so upon asking the HO for proof to work. The case worker asked for additional bank statements which i got. She later called and said the case worker said, ( my knowledge or consent ) he would put hers through if she withdrew mine.

rest is history.

i was never served any notice of rights or what happened only returned my passport.
