my solicitor refuse to refund my money back

hello can any one help,i paid half of my fee for my solicitor to process my application but my solicitor didn't send my application because i have paid my fee in full,and now i have change my mind about my application,but my solicitor refuses to refund me my full balance,i want to ask is it fair even when the job is not done

Check the terms and conditions you have agreed. It seems a little bit unfair to me. What are his reason to refuse refund?

You can write to him to let him know if he does not come to some sort of accommodation with you will report him to relevant authorities like http://www.lawsociety.org.uk/get-in-touch/complaints or

Bit confused - does he owe you half or your entire fee?

no i paid him £1200 for my visa application but he didn't want to continue any application until i paid in full,so i now decide not to continue with the application,i will wait till my duaghter is 7yrs to apply under 7yrs child application which will be in 6months time,and now i told my solicitor i don't want to continue anymore i will need my money back,but he write to me saying he fax my application to ukba that was since 6months no reply and he said he will take the fee for that,which i don't think is fair cos i was told i havent made any application

Well - you need to go back to the agreement you signed with him.

Does it talk about a non-refundable deposit of half the fee?

It might seem unfair - but equally if he's done lots of work filling out the form (even if it hasn't been sent - although he says it has) why shouldn't he have been paid for that work?

So you need some clarity about your agreement with him and you need some clarity about what he's actually done.

I would recommend asking your solicitor to provide u confirmation of that fax,
I have not heard that if any one could actually fax an application:o
Also try to negotiate to pay back at least half of the money you have paid.
Wonder why they didn't get ur permission or inform you before sending your application to home office

thank you for your reply,i negotiated with him if he can take £300 for just building up my files,but he took £750 out of my £1200 i paid him for not submitting any application,i just want to know if is right or wrong,cos is isnt fair to me

It depends what is in your contract with him. If he's a solicitor, he would have issued you a retainer letter. It will also set out the dispute resolution procedures if you are not satisfied with his service. If he's part of a firm then it's most likely writing a complaint to the Managing Partner.
