Some clarification needed

Post by bdonegan » Sat Dec 06, 2008 4:32 pm

Hi,

Myself and my wife (who I met in Ireland 2 years ago and married in the UK in March of this year) are thinking of moving back to Ireland sometime next year. I am Irish and she is Indian. We met while she was on a Student Visa. She arrived in Ireland at the end of August 2006 and left (to move to the UK with me) towards the end of August 2007. I think that gives her about 11 months of residence in Ireland so far.

With all of the background out of the way, I have two burning questions:

1.) What do we need to do upon arrival in Ireland to keep everything above board (presuming that by this time we are in possesion of a D-Spouse visa)? And how long will it take before she is able to work?

2.) Bearing in mind the period which she had stayed in Ireland previously, how long will it be before she can apply for citizenship?

We'll be very appreciative for any advice and information anyone has.

Thanks,

Brendan

Brendan

(1) If your wife enters Ireland with a D-Spouse visa, she needs to register with the GNIB soon after arrival. She will get a Stamp 4 on her passport and a GNIB card showing her visa status. She should also apply for a re-entry visa with INIS at the same time (if in the Dublin offices of DoJ). All the above are free of charge.
(2) Your wife will have to live with you in Ireland for 3 years before she can apply for citizenship.

Hi Brendan,

Are you working in the UK at the moment?
Does your wife have a UK Residence Card, issued in accordance with Directive 2004/38/EC (following an application on form EEA2)?
