South African with Spanish Residence traveling to UK

Post by grahamf » Sat Sep 19, 2009 4:19 pm

Hi

I hope i can get an answer as the UK Border Agency does not answer my question. When i e-mailed them they told me to look at their website.

I just want to know as i am a Spanish resident (which makes me a EU resident) living and working in Spain do i need a visa to travel to the UK.
My wife and daughter are on British Passports.

If i do need a Visa what one do i apply for, Visitor of Family of an EEA member. I read through the Family of EEA member and if i am correct i can only apply for that visa if my wife travels with me to the UK.

Any info and advise will be welcome

If your wife is exercising an economic Treaty right (i.e. as a worker or self-employed person) in another Member State (apart from the UK), and she is travelling with you, then you may apply for an EEA family permit.
EUN2.14 Can family members of British citizens qualify for an EEA family permit? ('Surinder Singh' cases) wrote:Because EEA nationals have an initial three months right of residence in the UK, there is no requirement for the British national to be a qualified person on arrival. Therefore, an EEA family permit can be issued to the non-EEA national family member of a British national even if they are only visiting the UK with the British national before returning to the Member State where they are resident.
Alternatively, if you are also a visa national, then you may apply for a visitor entry clearance.
