Speeding+Caution

Post by brad1980 » Tue Jun 10, 2014 10:57 am

Hello all

I just received a 3 point penalty+ fine for speeding offence :(.I also received a simple caution 4 years ago for a family dispute. I was going through AN guide and it states:
you must give details of all criminal convictions, these include Road traffic offences. Fixed penalty notices will not normally be taken into account unless you have failed to pay.

However in the booklet it reads: A non-custodial offence includes fines, Cautions, warnings and Reprimands and in the table it mentions that Application will normally be refused if the conviction occurred in the last 3 years.

Am I qualified to apply or I need to wait for my caution become spent for 5 years and then apply or I cannot apply anyway until 3 years? 

A THOROUGH clarification is highly appreciated as I am hearing very different opinions.

Best,
Brad

Where do you get that a caution becomes 'spent' after 5 years?

Thank you very much for clarification, very useful and informative. I could not find my answer in terms of traffic points, It is FPN but in addition to a fine I have 3 traffic points also, the question is whether this is considered as non-custodial conviction or not?
Thank you again

No, not if the fine and points were a FPN.
