Hi guys,
Please help
I am due to apply for ILR in the next month unfortunately my sponsor license has been revoke last month but we haven't received any letter from the HO curtailing our visa. I managed to find a new sponsor. My questions are:
1. Can I apply for ILR straight away or do I need to apply for FLR first?
1. My previous COS is for a senior health care assistant, if I transfer to a new company do they need to create a new job specification for me or can I used the same job description that is senior health care assistant?
Would appreciate your feedback on this.

Hi charo_lozada,
Its very unfortunate that your employers license is revoked at this moment when you are very near to ILR. But as you have another sponsor in line all is not lost.
If you apply right now for ILR ( without getting new Tier 2 ) then your application will be rejected. Reason is that you have no current sponsor as your current sponsor's license is revoked.
What you can do now is this:
First apply for new Tier 2 with the new sponsor and get your visa status sorted. Once you get new Tier 2 then get a letter fron new employer that your are required for the job and get a salary slip from them. Both documents are required from your employer for ILR on Tier 2(There are other documents also required. You can find it on the fourm).
After this you can apply for ILR.

My previous COS is health care assistant and I believed they don't issue cos for that job description already. Does my new employer need to create new job specification for me and advertise the job for 28 days? My visa is going to expire on 30 August 2015 and I am afraid I don't have enough time.
Would appreciate your thoughts

If your new employer has recruited you, they should be aware of the job code and job description for COS. They need to do RLMT unless the job they recruited you for is under shortage occupation list. Also make sure that you meet the minimum salary requirements for the job.

Hi Ravi,
I managed to get a new sponsor to extend my tier 2 but before that I consulted a solicitor and they advised me to put an application for flrfp to buy more time in case I cannot find sponsor before my they curtail my visa. The decision for flrfp Is still pending and I'm just waiting to finish the labour market test which is until 24th. I phoned UKVI helpline twice today but they have contradicting answers. One said that because I put a flrfp application then my tier 2 visa is automatically cancelled meaning I cannot apply to extend my tier 2 even with the new employer. The other agent said that I still can for as long as I withdraw my flrfp application before putting the extension for tier 2.
Can someone help me with this please whether someone from here has similar situation? Or advise me on what to do?
