Sponsoring mother from Pakistan

Post by 99sobi » Mon Apr 15, 2019 11:17 am

Hello.

I would appreciate some guidance on this matter.

I would like to sponsor my mother from Pakistan so she can visit me. I am her only daughter and her health is not good at the moment and I would like her to stay with me so that I can take care of her. She suffers from diabetes and blood pressure problems and it is difficult for her to stay healthy in Pakistan due to the poor/expensive healthcare.

Please can someone guide me to the documents/websites I need in order to sponsor her. Would she need a standard visitor visa, or a family member dependant visa? Would it be possible to get a visa that will eventually grant her leave to remain, as I do not want her to have to go back after 6 months.

Especially as my mother is a widow, and my husband passed last February, I would like to take care of my mother so that we can support each other.

There's also an issue with funds. Currently, I work part-time in a school and I only earn around £4000 a year, plus another £4000 in benefits, however this is sufficient for me and I have 5 kids and we are managing fine and I do not believe that having my mother over will affect the funds whatsoever.

The last time my mother came was in 2012, and that was sponsored by a relative, but none of my in-laws want to sponsor her.

Any advice would be appreciated.

In order for a visitor visa application to be successful, your mother will have to submit strong evidence of ties to her home country, including financial self-sufficiency. She needs to convince the ECO that she has more reasons to return home than she has to remain with you in the UK.

It's not possible to submit a settlement application while in the UK as a visitor. You should also consider that an Adult Dependent visa route has been virtually closed (apart for extreme cases), since the Immigration Rules were tightened significantly on the 9th July 2012. Only a few applications have succeeded and most of those after a lengthy and costly Court appeal.

In order to stand any chance of success, your mother would have to show that she needs daily help for basic tasks, such as bathing, dressing, preparing food etc. AND that care is either not available in her home country or is not affordable. The Entry Clearance Office would take the view that if you can afford to support her in the UK, you would be able to pay for care in her home country where the costs are much lower.

If you apply for an Adult Dependent visa and it is refused, you will be closing the door for any visits in the future due to the prior intention to settle.

On another point, if your mother is granted a visitor visa you should ensure that she has medical insurance for the duration of her stay as she will have no free access to NHS services.
Any treatment would be charged at 150% of the costs. She may however, not be able to obtain insurance to cover any existing medical conditions.

Your mother would have to be destitute/ homeless and have no access to help or relatives in her home country to achieve a dependent visa. Do not apply for this unless this is truly the case. As warned in the previous post, if this is applied for and not granted you can forget about ever getting a visit visa thereafter.

Given your stated income and mothers circumstances I doubt that is much hope of your mother getting a visit visa. What ties does she have with her home country? If there is little or nothing worthwhile to ensure her return then there is no option for the ECO but to refuse the visa.

Thank you so much for the advice. It's much appreciated.

The dependant visa was a bit of a stretch I admit, and I do recognise that the regulations have become a lot more stringent over the past few years.

My best bet would be to wait until my older children are able to sponsor her on a visitor visa.

Many thanks for the advice again.
