Sponsoring worker and her husband

Post by Oposum » Wed Apr 13, 2022 6:15 pm

Hello,

I have just received my sponsor licence and I cannot be more happy :)

I have a specific person who I would like to sponsor and I feel that she will be a perfect fit for my team. She is married and her husband would move with her but we (both me and them) are not yet sure if he would like to work with us or not. At the moment, our best estimate is that he will try to look for a job, and if he cannot find it, we might employ him while he looks for another job, so we provide both of them with more financial support during that time.

Can you please let me know if this would be legal (employing one person on defined cos and then her husband who has PBS dependant visa as well)? I tried googling but I didn't see any answers on this. If I am not mistaking, hiring one PBS dependant would be legal, and I am not sure would the fact that he is a PBS dependant of sponsored worker would have any importance?

Also, in case that something goes wrong (one of them gets fired or redundant), is there anything that either one of them could do to damage my reputation as sponsor (to cause me issues with licence)? It goes without saying that all salaries and employment factors would be in line with all regulations. I have recently received ILR and I will be applying for passport in a few months, so i don't want to stress about someone causing me issues just out of revenge or because the job is not as they expected and they get fired or if company stops doing well and someone is redundant.

Thanks!

It is fine. You are overthinking.

Thanks. However, can you please let me know what would be some of the things that might be hard to prove if I get reported as sponsor? I will obviously issue all payslips, use RTI payment submissions and pay salaries as bank transfer. I will also save all evidence for working hours. Is there anything I should also keep as record?
