Spousa Visa Application for germany

hello to all \\\ i am British Citizen ,live and work in Germany over 6 month now,, i am marred in iraq i have one child how do i support them to join me in germany permanetly ? please i need your help thank you very much [/b]

Since you are a British citizen and working in Germany, it is very easy for your wife and children to come to Germany.

You will need to give you wife:
(1) a copy of your passport information page
(2) a copy of your Anmeldung confirmation from the city hall where you live
(3) some proof that you are working, such as a pay slip or a letter from your employer
(4) a letter from your which says that you are a British citizen who is exercising your free movement rights by working in Germany, and that you wish your wife and child to join you as soon as possible on the basis of Freizügigkeitsgesetz/EU

This proves your are British and are working in Germany. There is no need to show how much you earn.

Your wife will need to show:
(4) her passport and the passport of your child
(5) your marriage certificate and the long form birth certificate of the child

That is all. She needs to just fill out a simple Schengen visa application. She does NOT need to fill out the fields marked with a star (*).

Your wife will need to apply at the visa section of the German embassy in Bagdad. See http://www.bagdad.diplo.de/Vertretung/b ... chaft.html The visa application is free and should be processed quickly.

She should keep a photocopy of EVERYTHING she submits.

Were you British at the time of the child's birth? Is the child British?

yes i was british when my child was born. but i think my child can be british?

but i have not applay any things for my child yets,
i cant go to bagdad , bagdad is not safe place for me to go as i am british citizen and i am kurdish i can go to ankara is ok.
my question is
on schengen visa my wife and my child can stay for 90 days? what happaen next on her visa?

and do i need prove of accommodation?

and what about helth insurance?
i was thinking befor u reply me first time ,she need Evidence of basic knowledge
of the German language to come to germany as my spouse, if u have more advice ,Appreciated thank you again[/b]

Do you already have a Freizügigkeitsbescheinigung? It is a simple confirmation that you are working in Germany as an EU citizen. See http://www.muenchen.de/rathaus/Stadtver ... aaten.html if you can read German.

Did you naturalize as a British citizen? Is your name on the child's birth certificate? Were you married at the time the child was born? If so then the child is already British.

But if the child has an Iraqi passport, then it likely makes sense to just go ahead with the EEA Family Permit. You can always get the British passport later (in Germany for instance). But there are other options!

Does the child have an Iraqi passport already?

You are working in Germany, so you (and your wife) do not need to prove or provide any information about accommodation or health insurance or German language.

I actually recently had a conversation with a Beamter in Germany about this. The junior person told me the wrong information (incorrectly said I needed to provide information about accommodation), and so I asked to speak with the a more senior person. The junior person rolled her eyes, and sent me to the senior person. The senior person agreed that she had made a "mistake" and that it was not required.

Schengen "tourist" visa is the one to have. It does not matter that it is only 90 days. In fact it is only needed to facilitate the initial entry into the country. They have an automatic right to be with you in Germany when you are working or doing similar things (called "Exercising your treaty rights").

Once they come to Germany, you can immediately apply for a Residence Card for both of them. It used to be issued instantly, but now takes about a month for the cards to be printed up in Berlin. You wife can work and your child can go to school (if old enough) immediately, but the Residence Card makes it easier to prove the right to work.

Perfect! Be sure to include a copy of that in the papers that your wife submits.
Freizügigkeit in German is the same as Freemovement in English.

Super. Your child is already a British citizen. He or she just needs to apply for a passport.

I lived in Germany for a while. I really enjoyed it. My German was really bad for a long time, but eventually it got better. You and/or your wife likely can get free German language classes if you have time for it.

How old is the child?

she is only about 5 month now , my wife was pregnant when i have to come bak to germany to work and try to bring them to here but did no how to bring them to here until yastrday u told me all that i realy realy thank you so much

Note that your wife and child can apply for a visa at ANY German visa section. There is a visa section in Erbil if that is anywhere nearby where you are. They claim to not handle cases like yours, but it may save you time and effort to push on them a little bit. They are in general required to go out of their way for cases such as yours.

i am not far from Erbil that sound is good . but i think embassy in erbil are open for limted vissa liek diplomat business and medical reason or some one work for gevorment , thanx again

But they are actually required to give you "every facility" to process the visa. Your wife should get service that is just as good as a diplomat...

hello every one in here, i am going to aply schengan visa under directive2004/38/ec for my non eu spouse and child in german embasy in ankara please corect me if i have not right document as i am Eu citizen work and live in germany. 1- child certificate &marriage certificate. legalization. 2- wife and child passport and visa aplacation form 3-work contract &payslip. and anmeldung confirmation. 4 - to many photo of our wedding plus normal photo of me and my wife and my child . and one moere thing i am here in iraq we well go to ankara next week aply visa for my wife and my child .hope thy give my wife and my child a visa then we are together travel to germany thanx for any advice from u guys ,i really thank you directive2004/38/ec

I think there is no need to submit the extra photos. Also you need to do two application forms - one for your child and one for your wife.

hello again here i am in ankara ,turky. is lovley city . so we got appointment tomorow on 20/01/2012 at 9am turist visa for my wife and my child as i am british citizen live and work in germany i would like to accompanying my wife and my 5 month old child to germany so i am going to submet 2 visa applacation forms 2 iraqi passport of them plus legalisation .marrige cert & child birth cert & letter from me say i am brithish citizen .... and regesteration latter from germany where i do live and a letter( 8 freizug G/EU ) and my work contract and letter from my employ .and wedding photo also bank statment and pay slip also and my passport to and i got every things copy and orignal . i hope german embassy they let me inside the embassy with my wife and my child to submet all our document ...good luk to me

i have submet all my document they told me u dont have any probleam they told my wife write i wish to stay in germany for 90 days and guy from embassy told me 99 percent u have visa but u have to waite 5 days . any ubdate well let u now guys thank you so so much dirctive 2004 /38/EC for all your help

hi again. we have been told by the guy from embassy my spouse and my child visa take 5 days and he told me to phone mrs ....... ask to how is my spouse and my child applacation going on nexet 3days .but today i have call my casse worker she told me maytake 10 dayes to 3 month to prossis but my spouse and my child on iraqi passport and got 1 month turkish visa and we pay every nite $62 for hotel .i was trying to explain my situation in turky but she was ungry and did not let me to explain for her she put it phone down on me ,,

3.4. Processing time

The visas must be issued as soon as possible and on the basis of an accelerated procedure and the procedures put in place by Member States (with or without outsourcing) must allow to distinguish between the rights of a third country national who is a family member of an EU citizen and other third country nationals. Processing times for a visa application lodged by a third-country national who is a family member of an EU citizen covered by the Directive going beyond 15 days should be exceptional and duly justified.

Most staff are well trained to give out conservative answers so that you don't come back and expect that it should be done. It might be the first person you talked with did not follow that rule.

I take 15 days to be work days, so 3 calendar weeks...
