Spousal Visa question - 10 year route

Spousal Visa question - 10 year route

Hi all,

I'm a USA citizen and have lived in the UK since 2015 on a tier 4 student visa. My husband is a UK citizen and we have a daughter together.

We're wanting to apply for a spousal visa, as my student visa is coming to an end, but although my husband's new job is above the income threshold, he doesn't have six months worth of payslips yet.

We meet all conditions otherwise and have lived together since I moved here. We were long-distance before and have been together since 2012, so there's no issues proving our relationship, if the baby wasn't enough. Furthermore, we've been married since dec 2018.

I read online that I could still apply for a spousal visa under the ten year route in my case. However, there's not as much info that I can find, opposed to the five year route. Am I right in thinking that the 10 year route would be the best for our situation? Is it more likely to be rejected over the five year route?

Also, on a separate note, would applying for the fee waiver reduce the chance of my application being accepted? We will get the money together if we need to, of course, but that is a significant amount for us.
