Spouse and child to the UK, wage error.

Post by philemon_bodiba » Thu Oct 16, 2014 8:44 am

Hi

I'm a South African and currently residing in the UK, and would like to apply for a Spouse visa for my wife and another visa for a dependent child. I earn at least £1900 every month and fully understand that I should be earning at least £1866.67 per month in order to meet the financial requirement for both.
However, an error in payment was made by my employer in one of my wage slips that the gross pay was £1211. Although my employer acknowledges that I was underpaid by nearly £700 gross they promised the error will be rectified by having the amount be paid into my next salary.
Since I'm need to make an application for my wife and child, would it be appropriate to submit a letter with the application informing the ECO about the the error in question?

My salaries are as follows:
May, £1900
June, £1900
July, £1900
August, £1900
September, £1211
And for October, it surely will be £2600

Looking forward to hearing from you.
Thanks.
Pa

The problem you have is that the lowest payment within the last 6 month period is multiplied to give the annual calculation. It's a question of whether the caseworker will accept your employer's statement regarding the error.

In addition to Casa's comment, the only other way around it is if you are in non salaried employment, i.e paid per hour, per day, etc.

£1866.67 x 12 months is £22,400

Well,if he's earning 1900 a month,that should be enough then 1900×12=22800.
The best you can do about the error is to apply under cat B if you've been earning this amount in the past 12 months, with cat B,they can't pick on that error, but your payslip for that month and bank statement must correspond even with the mistake or you might need to explain all that.
Make your employer acknowledge the error in writing now,and when you need to apply as well,so it doesn't look like it was specifically done for your application.

Thanks folks, for your replies.

Now here's another another scenario is that: If one still needs to bring a spouse and a child into the UK and he/she earns £1750 on a four-weekly basis, would they still meet the financial requirements under Category A - bearing in mind that four-weekly salary equals 13 payments a year and not 12?

Looking forward to hearing from you.
