Hello

I came to the Uk in December 2006 on a right of abode visa (not subject to any immigration control). On coming to the Uk I left my 2 daughters aged 20 and 1 and three sons aged 17, 16 and 14 together with my husband in Pakistan.

I currently work fulltime in the UK and hope to submit and application for them to come to the UK for settlement later this year. However I have been told by family and friends that any child over the aged of 18 cannot come to Uk for settlement (Uk legislation says so).

It would be grateful to know what supporting documentation i need to submit with my application. And secondaly is there an problem with me submitting an application so early when I will only have been in the Uk for one year when the application is lodged. and finally can i submit an application for my elder daughter.


I dearly await any response to my query

Children over 18 are difficult to obtain a settlement visa. You have not stated if they are dependant financially on you.

A little search gets:
Can parents, grandparents and other dependent relatives go to live in the UK?
If you are a widowed parent or grandparent aged 65 or over, or parents or grandparents travelling together and one of you is 65 or over, you may qualify if:

* you are completely or mainly financially dependent on children or grandchildren living and settled in the UK
* you have no other close relatives in your own country to help you
* your children or grandchildren can support you without needing help from public funds, and
* your children or grandchildren have enough accommodation, which they alone own or live in, where you can live without needing any help from public funds.

If you are a parent or grandparent under the age of 65, you may qualify if:

* you are living in the most exceptional compassionate circumstances
* you are completely or mainly financially dependent on children or grandchildren living and settled in the UK
* you have no other close relatives in your own country to help you
* your children or grandchildren can support you without needing help from public funds, and
* your children or grandchildren have enough accommodation, which they alone own or live in, where you can live without needing any help from public funds.

If you are over 18 and have a parent settled in the UK, or if you are a sister, brother, aunt, uncle or any other relative of a person settled in the UK, you may qualify if you meet the conditions listed in the previous paragraph and you are living alone in the most exceptional compassionate circumstances.

"Exceptional compassionate circumstances" means that they cannot function without your help. This makes it looks very unlikely they the children older than 18 can obtain a settlement visa.

Finally I send them money on a monthly basis, so in that case, yes they are finacially dependant on me.

The children under 18 have a different visa, so they are not a problem.
