ILR changes for my wife's application

Post by shohjura » Mon Dec 29, 2025 5:51 pm

hi guys,
hope everyone is doing well, got few questions about my wife's ILR application, she just received her extension based on my British passport (I got it on 10 year route, we also have a British son born here), she is due to apply for ILR in March 2028 (got her initial visa in March 2023), my questions:

-is the 5 year route still valid or is it being proposed to increase to 10 years?
-she has B1 Ielts, is it being proposed to change to B2 for ILR?
-same with Life in UK test-is it worth taking the test now?
-I claim child benefit (not her)-would it affect her application?
-can she apply for British citizenship straight after ILR or needs to wait for 12 months?

many thanks!

We cannot advise you on what to expect in 2028. No new rules have been announced and things are always bound to change without much notice. Some or all the rules regarding ILR are subject to change. Any advice based on the rules in place today are not that useful for 2028. Please come back in 2028 and seek advice in due time

Post by shohjura » Thu Mar 05, 2026 11:19 pm

Hi guys,
Has it been confirmed now that spouses of British citizens who are already on route to 5 year settlement need b2 English from march 2027 or it is still to be confirmed? Conflicting info going around in the web, thanks

It seems it does not affect people under Appendix FM, it only applies to people under Appendix Settlement Family Life (10-year partner or parent route)
Change to English language requirements
5.60 This change increases the English language requirement for settlement to B2 level under the Common European Framework of Reference for Languages (CEFR) for a number of immigration routes where the existing requirement is at B1 level. The changes apply to those routes covered by Appendix KoLL; Appendix Skilled Worker; Appendix Tier 2 Minister of Religion; Appendix Representative of an Overseas Business; Appendix UK Ancestry; Appendix Global Talent; Appendix Scale Up; Appendix Innovator Founder; Appendix International Sportsperson; Appendix Child Relative (Sponsors with Protection); Appendix Long Residence; Appendix Bereaved Partner; Appendix Private Life; and Appendix Settlement Family Life; and make consequential amendments to Appendix English Language.
.
.
5.62 These changes will come into force on 26 March 2027. The changes will therefore apply to those already on a pathway to settlement in the UK and the rules applying to the Skilled Worker route and Scale Up routes are accordingly amended to apply the language requirement at settlement stage in addition to the requirements specified for a limited permission. The coming into force of these changes is being deferred until 26 March 2027 in order to provide those subject to the new requirements with sufficient opportunity to take any steps necessary to meet them.

Hi Zimba, thanks for that
it says it will apply to those covered by Appendix KOLL and that includes spouses? because that part of appendix FM includes a requirement of KOLL

You are correct. It seems it applies to Appendix FM too
