Hi there!

I have a question about upcoming spouse/fiance visa. We're still deciding which route to go, as I'm waiting on my divorce from my previous partner and I'm unsure of how our financial situation would affect the applications.

I'm back home in Canada and have been working for a few months. My partner makes £28k but lives in London for work so I have been helping him by sending money for bills.

I believe that would rule us out for the fiance visa since it would mean I'd have to work to support us - which isn't allowed on that type of Visa. He has to be able to support us while I'm unable to work in those six months.

But, would it have a negative effect on a spouse visa? Since I would be able to work right away upon moving, I could start working and contribute to the bills right away.

I couldn't ask him to move into a less expensive place where I don't contribute to the bills, as the only places would be single rooms where we wouldn't be able to live together when I arrive. So, I'm not sure how to navigate this situation.

Any advice would be super helpful!

Why not marry after divorce in Canada or anywhere else in world other than UK and apply straight spouse visa and get right of work. Also be remembered that whether you work (if allowed) or not work won't have any affect on anything as long as your partner can earn at least £18600 to meet the requirement.

I think that's our best option right now. If we do though, will it matter that I was sending him money while I was at home? I know it wouldn't look like we're trying to do any fund parking because his payslips show that he makes well above the threshold but I still worry that it would look bad on our application for some reason.

You are overthinking.

HO is only concerned about his salary and bank statements showing he meets the financial requirement.
