Spouse need to wait for a year for BC?

Post by jinn_baba » Sun Sep 15, 2019 10:45 am

Hi,
I am wondering if my wife needs to wait for a year after ILR to file for BC. I came to UK on Tier 2 General in 2013 and got my BC few months back. Rest of the family had come in June, 2014 so were not eligible for ILR with myself. Filed for wife’s ILR very recently but wondering if/when she gets it, will she have to wait for another year for BC or right away and will this rule apply to her which seems to imply she can do so right away:

You can apply for British citizenship by ‘naturalisation’ if you:

are 18 or over
are married to, or in a civil partnership with, someone who is a British citizen
have lived in the UK for at least 3 years before the date of your application
You can apply as soon as you have one of the following:

a permanent residence document to prove you have permanent residence status
indefinite leave to remain in the UK
‘settled status’ (also known as ‘indefinite leave to remain under the EU Settlement Scheme’)
indefinite leave to enter the UK (permission to move to the UK permanently from abroad)
You must also:

prove you were in the UK exactly 3 years before the day the Home Office receives your application
prove your knowledge of English, Welsh or Scottish Gaelic
show you’ve passed the life in the UK test
be of good character - read the naturalisation guidance

Some other residency requirements

Thanks in advance!

She can apply for BC straightway as a spouse of a BC, assuming she satisfies the other conditions
