EU Spouse - step by step instructions needed

Post by galop » Thu Mar 19, 2009 7:37 pm

Hello all,

There is a bewildering amount of information out there and I was wondering if anyone can give me some clear step-by-step instructions on what I should do in the following situation.

CURRENT SITUATION:
I am a Dutch national, currently living in Spain with my wife, a Bolivian national, with a Spanish EU spouse residence permit.

CHALLENGE:
I got a temporary job offer for a 6 month job in Dublin, and I want to take my wife with me, who will ideally also be working in Dublin.

QUESTIONS:
What do we need to do to accomplish this? EU1 application? (Do we really need to send passports by mail and do we really have to wait 6 months for this?) Stamp 4Eufam? (How and where do you apply for this, if at all? What paperwork is needed?) Stamp 4? Temporary Stamp 4? PPS number? How long is all this going to take?

I hope someone can help me!

Many thanks.

How long have you been in Spain and is your wife eligible for Spanish citizenship?

Hi Galop!

Yes. Since your residence will be in excess of 3 months, and EU1 application must be submitted for your wife.

You could send certified copies instead.

The Residence Card must be issued within 6 months, however a certificate of application for the Residence Card must be issued immediately. In practice, you should get this in 1-2 weeks.

"Stamp 4 EUFam" is the Residence Card of a family member of a Union citizen, referred to in Article 10(1) of the Directive. This is issued following approval of the EU1 application. Documents needed are proof of nationality for you and your wife, proof of relationship between you and your wife, proof of residence in Ireland, proof of employment in Ireland (in your case).

Once your wife has received the certificate of application, she (with you) may visit the GNIB office and get Stamp 4, valid for 6 months (by which time the EU1 application will be processed). Stamp 4 and Stamp 4 EUFam is equal for the purpose of employment rights in Ireland.

A PPS number can be applied for right away. You need to show each of your passports (or National ID card), plus evidence of your address. If you do not have evidence of your address, because you are living (at that time) with friends, they can go with you and provide proof of their address, plus a note confirming that you are living with them.

  • PPS number, should be issued within about 2 weeks of application.
  • Certificate of application of a Residence Card of a family member of a Union citizen, should be issued within about 2 weeks of application.
  • Temporary Stamp 4 card, can be claimed from the GNIB immediately up receipt of the certificate of application.
  • Stamp 4 EUFam Residence Card, must be issued within 6 months of application.

Thanks for responding.

We've been here (legally) since October. Does this affect the situation?

I think what we are going to do is go to the Gardai GNIB office and see if they will give us a stamp 4. I've heard sometimes they do that before submitting the EU1 application.

Obviously, waiting 6 months for a EU1 approval doesn't make much sense if our stay is only going to be 6 months to begin with.

Thanks for your response, Benifa. The certified copy thing sounds like a good idea, I'll look into that.
