Spouse visa of EEA can be affected by Tax credit??

Post by Catriona » Sun Mar 06, 2011 12:43 am

Hello.
I just would like to ask for an advise. Im, NON-EEA on student visa, getting married to an EEA citizen. After wedding I will be applying for a spouse visa. The only problem is that my fiance is claiming Tax Credit and he is self-employed.

And Im currently working part time in the same company for over 3 years with perspective of promotion after changing my status.

I want to find out if claiming Working tax by my EEA fiance could affect my application for spouse visa. And how much should he be earning in order to satisfy home office regulation for being able to support me?

And if he will cancel Tax credit now (application will take place only in September) the record is still will be there?

Thank you.

You say after you are married you are going to apply for a spouse visa

Do you mean a residence card for a non-EEA family member of an EEA national?

Where are you getting married? If in the UK do you have a certificate of approval to marry or are you getting married in an Anglican church?

there is no requirement that your partner has to be earning a certain amount to maintain you if you are apply under the EEA route. There is also no restriction on him claiming any benefits to which he is entitled.
