SPOUSE VISA FROM INDIA

Post by sherb » Tue Nov 25, 2014 7:37 pm

HI,

I am an Indian married to a British Citizen, I was refused special marriage visa (fiancé visa) as the visa officer was not sure i would leave UK after the 6 months in (june 2014), so we got married here in india in Sep 2014.Now i want to apply for the spouse visa, I am not sure about all the documents I need to produce and i'd be very happy if anyone from the forum can help me with the same.I do not want this to get rejected so I am making sure i have it all right before i apply again.
My husband works there and earns around 2000 GBP/month, I'm not working in india but i do have savings.Do i need to show property her in india or does that matter at all?

regards
Sherb

What you'll need to produce on your part are
1. Your passport
2. Tb certificate
3. Proof of English at A1,if you're a graduate you might not need that, you can get naric statement of comparability & English language assessment.
4. Your completed online application form & vaf4 form.
5. Passport photograph.
The rest will be produced by your spouse. You don't necessarily need to be working or show any property.
You might also need to explain some of the point you were refused on your initial application but that shouldn't affect your application if you have concealed any information.
Try and digest this first, then we'll take it from there.

Did you previously apply for a marriage visit visa or a fiancé visa? The latter does not require you to leave the UK after marriage.

You may apply to join your husband (Appendix FM-SE, English, Guidance).

Notes:
Spouse & partner: If you intend to apply under the spouse and partner route you must provide evidence that you have passed the speaking and listening components of a test at level A1 or above. You do not need to demonstrate reading and writing skills. Where a test examines all four components (speaking, listening, reading and writing) you do not need to pass the reading and writing components, you only need to evidence passing the speaking and listening components.
Settlement: If you intend to apply under the settlement route you must provide evidence that you have passed the speaking and listening components of a test at level B1 or above. You do not need to demonstrate reading and writing skills. Where a test examines all four components (speaking, listening, reading and writing) you do not need to pass the reading and writing components, you only need to evidence passing the speaking and listening components.
