Spouse Visa help (strange situation)!!!!

Hi there,

Please i need some advice on the following issue..

My wife's UK Settlement visa refusal decision was withdrawn back in May last year, but the british high comission made a mistake and failed to inform anyone of this. So we got a court hearing and when we attended the Judge informed us that your refusal decision was withdrawn back in May and your wife should have already been here. So we sent an email to: STE.UKHUB@fco.gov.uk explaining the situation. They sent us an email back stating that they are investigating why there was a delay with the application and they will get back to us with an update shortly.

Was this the right action to take? isn't there any way i can ring them or something. Is there any other email address i should contact them by?

Please advise me on this, i'm stressing so much, i also have a son who is 14 months and i miss him so much..they should have been with me now if they didn't make this mistake.

My advise would be wait to hear something from UKBA. Thye probally are looking into matter right now and no doubt will contact you as soon as they have carried out their investigation in the matter

I usually agree with batleykhan but in this case I would be straight onto my MP and ask him to contact the High Commission IMMEDIATELY and ask them to issue the visa without delay. They can carry out any investigation later. The fact of the matter is that they have withdrawn their refusal and they have obviously notified the judge of this, in which case the visa should be issued without any undue delay. Otherwise you could be waiting months.

In the email we sent them we mentioned that if this is not sorted out quickly we will contact our MP and take further action. We also mentioned something about a judicial review.

I think i will give them abit more time and if i don't here anything then i will contact the MP and get him to send a letter.

I belive Judicial review is the best thing to do in this case,knowing how much delay in yours case.

contact yours mp and ask him for help.if this does not work out then make an application for judicial review.With this application also apply for costs occurred in yours case as this is clearly eco mistake.

Hello,

Hope everyone is well.

Its been nearly 7 weeks now and we have heard nothing from them. My lawyer sent them an urgent email 2 days ago threatening them with a Jr for the last tme. Do u advise any other action we should take? Do u think we should wait for another week or so?

ironbeard,

You should definitely write to your MP or call the MP office. Normally there would be a caseworker in your MP office to assist you.
Where they should be able to enquire on your behalf in regards of your case directly with someone in charge of UKBA-International Group.

It's clearly shows the incompetency of the ECOs and ECMs of that particular UKBA post for never bother issuing the visa. :(
