hi guys,
I'm new here and not sure how this site works, and looking for a little insight.
I came to the UK in 2016 November on a spouse visa,
we have finished our 2.5 years and successfully applied for the second bit of our spouse visa which was another 2.5 yrs, that was around July 2018 and expires in Feb 2022.
currently my visa is about to end in Febuary 2022 before applying for ILR.
BUT...
Last year in March 2020, when covid-19 started, I came to Kenya to be with my family as my step Grandfather passed away from suspected Covid-19, then there were a few global and residential lock downs, high death rates, hotel quarantining, my youngest brother caught delta and was seriously ill, there after my grandmother got terminally ill and passed away (mid September she was diagnosed with an illness and passed away of Covid-19 delta in July) and now my mother was diagnosed with a brain tumor (its been a tough year for everyone im sure) and so we have over stayed "our stay" which was/and still is completely out of my control.
I am aware they wer a number of times we could have returned to the UK last year and this year, especially this month as Kenya is no longer on the "red list".
Our daughter, now aged 3 yrs is currently with me too. she is a British citizen.
Seeing that i have only have 3 months left to apply for ILR and also factors such as we have been out of the UK since march 2020 (being 1 year and 9 months to this date of absence) and now not having the finical requirements to fit our visa profile is there any way forward to still apply for our ILR or extension later on if
1.We stay with my ill mum or
2. Should we pack up and just come home to the UK in hopes i can still apply for ILR.
could someone assistant me with some advice on what could be the next step?
i have one other sensitive factors to add but would feel more comfortable adding once i know if there's a step forward. I do miss home(the UK) very much all my friends and other half of the family is on that side.
